3. 2026년에는 특허평가보고서도 확인해야 합니다

The fourth application round for Korea’s 2026 Excellent Procurement Product designation is scheduled for October 1–16, 2026.
For companies that already own patents, it is tempting to assume that having a patent is enough to support an application. In practice, the key issue is not simply whether a patent exists, but whether the patented technology is clearly and credibly embodied in the product being submitted for designation.
1. Confirm that the patent itself is eligible
According to the Public Procurement Service (PPS), patent-based applications must rely on a Korean registered patent, and the patent must generally be within seven years from registration.
An overseas or international patent by itself does not qualify for this route, and a pending patent application cannot be used as the qualifying patent technology.
Before preparing the application package, companies should therefore confirm:
- that the relevant right is a granted Korean patent;
- that fewer than seven years have passed since registration at the time of application; and
- that the right is granted rather than merely pending.
2. Product-to-patent alignment matters more than simply owning a patent
The Excellent Procurement Product system evaluates products with superior technology and quality. A patent certificate alone does not explain whether the patented technology is actually implemented in the product under review.
From a practical IP perspective, the core technical features described in the patent should align with the actual structure and function of the submitted product. Companies should review whether:
- the key elements of the independent claims correspond to the core product configuration;
- the product specifications describe benefits that logically arise from the patented technology;
- the application materials overstate features that are not actually supported by the patent; and
- the true differentiating technology is clearly reflected in both the patent and the procurement documents.
In many cases, a coherent patent-product-specification narrative is more important than simply attaching a patent registration certificate.
3. Check the patent evaluation report requirement
The PPS 2026 designation plan states that a patent evaluation report is required from the second application round onward among the prescribed application materials.
Applicants preparing for Round 4 should therefore confirm the applicable report requirements well before the filing window. The patent evaluation and the product submission should also tell the same technical story: what is technically distinctive, why it matters, and how that distinction is embodied in the product.
4. The first-stage technical review places significant weight on the submitted documents
For the 2026 designation process, the PPS states that the first-stage technical review is conducted without a separate presentation deck, based on the submitted application materials.
This makes document consistency particularly important. Patent-based applicants should review the alignment among:
- the granted patent and claims;
- the Excellent Procurement Product application;

- the patent evaluation report and other quality-supporting materials.
A useful test is whether the company can explain, in one clear sentence, what makes the product technically different, which patent protects that difference, and how the patented technology is implemented in the actual product.
5. What to review before the October filing window
With the Round 4 filing period set for October 1–16, 2026, patent-based applicants should consider reviewing the following now:
- patent registration date and current legal status;
- claim-to-product mapping;
- consistency between the patent and product specification;
- required quality-supporting evidence;
- patent evaluation report requirements; and
- consistency across the complete filing package.
The PPS indicates that designation is generally valid for three years, with possible extensions of up to three additional years subject to applicable conditions. A well-structured patent and product strategy can therefore support not only the application itself but also the company’s broader public procurement strategy.

Where a patent is already granted, preparing an Excellent Procurement Product application is often less about obtaining another certificate and more about demonstrating that the existing patent genuinely protects the product’s commercial and technical differentiation.
If the product has evolved beyond the scope of the existing patent portfolio, the better strategy may be to review follow-on filings or portfolio reinforcement rather than relying on application drafting alone.
