A. 아닙니다.

English Version

Founders frequently ask whether a new product requires all three forms of protection and which application should come first. There is no universal filing order because the rights protect different assets.

Patents focus on qualifying technical inventions, trademarks identify the commercial source of goods or services, and design rights protect qualifying visual appearance. Filing priorities should reflect disclosure risks, launch schedules and business value.

1. Understand what each right protects

A patent may protect a qualifying technical solution, such as a mechanical structure, battery-control method or manufacturing process. Patentability depends on statutory requirements including novelty, inventive step, industrial applicability and adequate disclosure.

A trademark protects a sign that distinguishes the source of goods or services, such as a brand name or logo. Earlier similar marks, distinctiveness and designated goods or services are important. Business or domain registration does not automatically create trademark rights.

Design registration protects qualifying visual features, such as the shape, pattern, color or combination of features of a product. A single product may benefit from all three forms of protection, but filing all three is not automatically necessary.

2. Consider patents and designs before public disclosure

Public disclosure is a major timing issue for technical inventions and product designs. Earlier public information may affect novelty, even where the inventor or designer disclosed the material personally through an exhibition, product page, video or presentation.

Korean law provides certain exceptions for qualifying disclosures within specified 12-month periods, but these are not unconditional safe harbors. The exception may not apply to every disclosure, does not generally backdate the filing date, and may differ internationally.

If a trade show, crowdfunding campaign, product demonstration or academic presentation is approaching, evaluate the relevant patent and design filings before disclosure. Where practical, filing before public release is the safer strategy.

3. Investigate trademarks before investing in branding

Trademark protection concerns the commercial identity of goods and services. Discovering an earlier conflicting mark after paying for packaging, signage and advertising can create substantial rebranding costs.

A clearance search should look beyond exact matches. Similar pronunciation, appearance or meaning, together with the similarity of designated goods and services, may affect registrability. Classification numbers alone do not determine legal similarity.

Where several brand candidates exist, search them before choosing a final name. Determine the goods and services that reflect the actual business plan rather than selecting an arbitrary or excessive range.

4. Prioritize the greatest business risk when budgets are limited

Filing every possible right in the broadest form is not always efficient. Compare the risk of losing novelty through disclosure, the competitive importance of the product’s appearance, and the cost of changing a brand.

A new mechanical structure scheduled for public exhibition may make patent filing urgent. A visually distinctive household product with little technical innovation may call for design protection first. A franchise or branded online business may prioritize trademark clearance and filing.

These are decision-making examples, not fixed legal rankings. Consider the state of development, existing rights, disclosure schedule, likely imitation and commercial objectives.

5. Cost control is more than minimizing application counts

The overall cost of protection may include filing, examination requests where applicable, registration, responses to objections, maintenance and foreign filings. The fee structure differs across patents, trademarks and designs.

For patents, identify the core inventive concept and relevant embodiments, and draft claims with an appropriate scope. For trademarks, select the marks and designated goods that fit realistic business plans. For designs, consider the complete product, distinctive portions and commercially important variations.

Avoid redundant filings, but do not omit valuable protection merely to reduce the initial fee. Claims that are too narrow may be ineffective, while unsupported breadth can lead to objections and additional costs.

6. Example: protecting one product through three rights

Consider a portable air-purification device. A novel filter coupling or airflow control method might be evaluated for patent protection. The distinctive shape of the housing or visual arrangement of the controls might be evaluated for design registration.

The product name and logo might be protected through trademarks. These rights serve different functions: technology, appearance and brand identity.

If the product uses established technology and ordinary appearance but relies on a distinctive commercial brand, trademark protection may deserve greater priority. The final strategy depends on the product and searches of earlier rights.

7. What about overseas sales?

Korean patents, trademarks and designs generally do not automatically grant equivalent exclusive rights abroad. Territorial protection and local legal requirements matter.

Depending on the right and the countries concerned, applicants may consider priority claims, the PCT route for patents, the Madrid system for trademarks and the Hague system for designs. An international filing route does not itself guarantee registration in every designated country.

Identify important manufacturing and sales markets, budgets and launch dates early. Foreign disclosure rules and priority periods may differ across rights and jurisdictions.

8. Practical pre-filing checklist

Prepare a summary of technical features and operating principles, key visual design elements, proposed brand names and logos, public launch dates, any earlier disclosures, target countries, ownership and contractor agreements, and the available budget.

Search relevant patents, trademarks and designs through KIPRIS and compare the closest results. No exact search hit does not guarantee registration. Patent inventive step, trademark similarity and design creativity require separate legal and technical assessments.

Create a timeline showing which rights may need filing before exhibitions, demonstrations, advertising, investor presentations or product sales.

9. Frequently asked questions

Q. Does a patent also protect the product’s brand and appearance? A. No. These rights protect different subject matter.

Q. Can trademark filing wait because I have a business registration? A. Business registration does not automatically create trademark rights; clearance before major branding expenditure is advisable.

Q. Must all three rights be registered before launch? A. Not necessarily. Filing and registration are distinct, and the order depends on the relevant risks and deadlines.

Q. What is the cheapest strategy? A. Prioritize commercially significant assets, conduct appropriate searches and avoid both unnecessary filings and important gaps in protection.

Conclusion: prioritize risk, not a fixed filing sequence

There is no universal rule that patents must always come before trademarks or designs. An imminent technical disclosure may prioritize patents; a planned public reveal of a distinctive product appearance may prioritize designs; a major branding campaign may prioritize trademarks.

The effective approach is to distinguish the assets, assess earlier rights, and coordinate filings with public disclosure and business plans. This can reduce avoidable rebranding, refiling and protection gaps.
