Using Patents to Secure Business Financing: What Should Companies Prepare Before an IP-Backed Loan Valuation in 2026?
For a technology company, a patent can become more than a registration certificate. At certain stages of growth, intellectual property may support a financing transaction, particularly where the company has limited tangible assets but commercially meaningful technology.
The Korea Invention Promotion Association’s 2026 IP-Backed Loan-Linked Intellectual Property Valuation Support Program supports IP valuation costs in connection with financing secured by intellectual property. The official program period is listed as February 26 through December 31, 2026.
A critical distinction comes first: an IP valuation is not the same as a loan approval. A valuation report may help a financial institution assess technology, legal strength, market relevance and economic value. The final credit decision, amount and terms can still depend on the lender’s underwriting, financial condition, repayment capacity and transaction structure.
Official notice: KIPA 2026 IP-Backed Loan-Linked Intellectual Property Valuation Support Program
1. Identify which patent actually supports the financing story
A company may own many patents, but not every patent has equal commercial relevance. The starting point is to identify rights that directly protect the core product, service or technology.
Review whether the independent claims cover the commercial implementation, whether competitors can design around the claims, whether protection exists in key foreign markets, how much patent term remains, and whether there are validity, ownership or enforcement issues that could affect value.
The objective is not to present the longest patent list. It is to identify the rights that matter to the business.
2. Corporate ownership does not end the ownership inquiry
Even when a patent is registered in the company’s name, due diligence may be required. Joint development, university collaboration, government-funded R&D, contractor development, employee inventions and licensing arrangements can affect the legal position.
Useful materials include current register information, assignment history, joint-development and technology-transfer agreements, licence agreements, employee-invention records, government R&D agreements, and any security interests or exclusive licences.
A late-discovered ownership issue can delay both valuation and financing.
3. Build a patent-to-product-to-revenue map
A strong financing narrative connects the legal right to a commercial activity.
A practical internal structure is:
Core patent → protected technical function → product → customer segment → current or projected revenue → competitive advantage
For pre-revenue technology, testing, proof-of-concept results, customer discussions, certification progress, pilot projects and manufacturing plans can help demonstrate commercialization potential.
4. Strong technology does not automatically mean strong patent protection
A technically impressive product may be protected by narrow claims or claims that competitors can avoid. Registered status alone does not answer questions about commercial scope.
Companies should review independent claims, prosecution amendments, key prior art, competitor products, design-around risk and the need for follow-on filings.
SKY’s Enterprise IP Portfolio service focuses on business alignment, ownership, claim scope, foreign expansion and follow-on protection rather than patent count alone.
5. Filing more patents immediately before valuation is not always the answer
Rapidly increasing patent count may not improve the quality of the financing case. A smaller portfolio that clearly protects the core product can be more meaningful than a larger set of overlapping or commercially irrelevant applications.
New filings should serve a specific purpose: capturing improvements, reducing design-around risk, covering next-generation products, entering foreign markets or building combined patent, design and trademark protection.
6. Patent materials and business materials must tell the same story
Valuation submissions, business plans, investor materials and financial records should be internally consistent.
Cross-check company presentations, financial statements, product-level revenue, major customers, market assumptions, competitor analysis, the R&D roadmap and the patent-to-product mapping.
An IP valuation does not cure inconsistencies in company records. It may reveal them.
7. IP-backed loans, guarantee-linked valuations and investment-linked valuations serve different purposes
Korea operates different IP valuation pathways for lending, guarantee-backed financing and investment review. They should not be treated as interchangeable simply because each involves IP valuation.
The appropriate pathway depends on the financing objective and counterparty.
Companies preparing for investment can also review SKY’s article What Should Patent-Holding Companies Prepare Before Applying for Investment and Commercialization Support?.
8. Practical checklist before valuation
- Define the financing purpose and expected capital need.
- Select patents directly connected to the core business.
- Confirm ownership, legal status, licensing and encumbrances.
- Map claims to the actual product.
- Review prior art and design-around risk.
- Organize sales, contracts, testing and certification evidence.
- Align IP materials with financial and business-plan data.
- Coordinate the valuation timeline with lender review.
- Address follow-on filings, foreign filings or ownership clean-up if necessary.
Conclusion
Patent-backed financing is not driven by patent count alone. The key questions are whether the IP protects the real business, whether ownership and legal status are clean, whether the rights connect to products and revenue, and whether the IP narrative is consistent with the company’s business records.
The 2026 IP-backed loan valuation support program can reduce the burden of obtaining an IP valuation, but valuation and the lender’s final credit decision remain distinct.

Documents to assemble before an IP-backed loan or valuation
Before seeking an IP-backed loan, organize the patent, business and financial records as one consistent evidence package. Useful materials include the current patent/application list and ownership information, a mapping between each key patent and the actual product or process, recent sales or licensing evidence, agreements affecting ownership or licences, and a clear financing/use-of-funds plan. Consistency across those records is important because a valuation considers not only the existence of a patent but also its legal position, commercial relevance and actual use.
