또한 이 프로그램은 민간 주관기관의 지원사업입니다. 정부기관이 직접 기업의 특허가치를 보증하거나 투자를 보장하는 제도로 오인해서는 안 됩니다.

투자 검토에서 특허 건수만 보여주면 부족한 이유

투자자 또는 평가자가 IP를 보는 목적은 특허등록증을 확인하는 데 있지 않습니다. 일반적으로 더 중요한 것은 특허가 사업의 경쟁우위와 연결되어 있는지입니다.

예를 들어 특허가 15건 있어도 대부분 현재 판매하지 않는 과거 제품에 관한 것이고, 핵심 매출제품은 경쟁사가 쉽게 우회할 수 있다면 포트폴리오의 사업적 설명력이 약할 수 있습니다. 반대로 특허가 3건뿐이어도 핵심제품의 진입장벽을 형성하고 후속 기술과 해외시장까지 확장 가능한 구조라면 훨씬 명확한 IP 스토리를 만들 수 있습니다.

따라서 신청 전에 단순 특허목록을 다음과 같이 재구성하는 것이 좋습니다.

핵심특허

현재 매출 또는 향후 핵심제품의 차별기술을 직접 보호하는 권리입니다. 독립항이 실제 제품의 핵심구성을 어떻게 포괄하는지 확인합니다.

방어특허·주변특허

경쟁사의 우회설계를 어렵게 하거나 제품군의 확장을 보호하는 권리입니다. 핵심특허와 어떤 관계인지 설명할 수 있어야 합니다.

미래특허·출원 중 기술

아직 매출이 발생하지 않더라도 다음 제품, 신규시장 또는 새로운 비즈니스모델과 연결되는 출원입니다. 투자금이 투입될 경우 어떤 기술로 성장할 것인지 보여주는 자료가 될 수 있습니다.

사업과 연결성이 낮은 권리

모든 특허를 핵심자산처럼 포장할 필요는 없습니다. 현재 사업과 연결성이 낮다면 별도로 분류하는 편이 오히려 포트폴리오의 신뢰성을 높일 수 있습니다.

IR 자료와 특허자료는 같은 숫자를 말해야 한다

투자자료에서 자주 생기는 문제는 사업팀과 특허자료의 기준이 다른 것입니다.

IR에서는 “독자적인 AI 엔진이 핵심기술”이라고 설명하지만 특허는 하드웨어 케이스 구조에 집중되어 있거나, IR에서는 글로벌 진출을 강조하지만 해외출원은 전혀 준비되지 않은 경우가 있습니다. 반대로 특허에는 좋은 기술이 들어 있는데 IR 자료에서는 단순히 “특허 7건 보유”라고만 표시해 그 가치가 드러나지 않는 경우도 많습니다.

투자 또는 사업화 프로그램을 준비한다면 최소한 다음 네 가지를 맞춰보는 것이 좋습니다.

  1. IR의 핵심 경쟁력과 핵심특허가 일치하는가?
  2. 현재 매출제품과 등록특허의 청구범위가 연결되는가?
  3. 향후 제품 로드맵과 출원계획이 연결되는가?
  4. 해외시장 계획과 해외 권리화 일정이 현실적으로 맞는가?

  • 공동권리자가 있다면 사업화와 라이선스에 제한이 없는가?
  • 직무발명 또는 공동개발 과정의 권리귀속 문서가 정리되어 있는가?

“특허가치”를 등록 가능성과 혼동하지 말아야 한다

특허가 등록되었다는 것은 해당 출원이 심사를 거쳐 특허권으로 성립했다는 의미입니다. 그러나 사업가치나 투자매력은 별개의 문제입니다.

투자 관점에서 IP를 설명하려면 다음 질문이 추가됩니다.

  • 해당 기술이 해결하는 시장문제가 충분히 큰가?
  • 경쟁사가 동일한 효과를 내면서 쉽게 회피할 수 있는가?
  • 특허의 존속기간과 사업의 성장기간이 맞는가?
  • 실제 제품이 권리범위 안에 들어오는가?
  • 경쟁사의 선행권리 때문에 사업화가 제한될 가능성은 없는가?
  • 후속 제품과 해외시장으로 포트폴리오를 확장할 수 있는가?

즉, 특허성·권리범위·FTO·사업성·시장성을 하나의 단어인 “특허가치”로 뭉뚱그리면 안 됩니다.

지원사업 선정이 끝이 아니라 투자실사 준비의 시작

Patent-Holding Companies Applying for Investment Support: A Patent List Is Not an Investment-Ready IP Strategy

A 2026 program titled “Investment & Commercialization Scale-Up Support Program for Domestic Patent(IP)-Holding Companies” is accepting applications through September 30, 2026 at 18:00, according to the official notice issued by the Innovation Technology Management Certification Support Center.

The program targets startups and SMEs holding Korean patents or pending Korean patent applications and is designed to support companies seeking to use IP in investment and commercialization. The announced benefits include investment-direction consulting, links to patent and investment support programs, and, for qualifying companies that submit IR materials and pass accelerator review, an investment feasibility diagnosis report.

For companies, however, the more important issue is not the number of patents owned. The real question is whether those patents explain a defensible business advantage.

What investors need to understand about the IP portfolio

A company with fifteen patents may still have a weak IP story if most rights relate to discontinued products while the current revenue-generating product can be easily designed around. A company with three well-positioned patents may have a stronger story if those rights protect core product architecture and can expand into future products and overseas markets.

A useful portfolio classification separates core patents, defensive or surrounding patents, future-oriented pending applications and rights with limited relevance to the current business. Not every patent needs to be presented as a crown-jewel asset.

Align the IR deck with the patent portfolio

A frequent diligence problem arises when the business narrative and the IP documents describe different competitive advantages. An IR deck may identify a proprietary AI engine as the company’s core technology while the patent portfolio focuses on unrelated hardware. Another company may claim global expansion while having no remaining foreign-filing strategy.

Before an investment-oriented support application, companies should test four alignments:

  1. Does the core competitive advantage in the IR deck match the core patent claims?
  2. Do current revenue products map to existing rights?
  3. Does the product roadmap connect to a future filing strategy?
  4. Does the international market plan match realistic foreign filing deadlines and budgets?

Ownership can be more important than patent count

Early-stage companies often begin with patents filed in a founder’s personal name and later move operations into a corporation. Technology may also be developed with co-founders, contractors, universities or research institutes.

Before investment review, companies should verify whether the operating company owns or has secure rights to use the IP that supports the business. Relevant questions include whether patent owners match the operating entity, whether founder-owned rights should be assigned, whether co-ownership creates commercialization constraints, whether employee-invention records are complete, and whether development agreements clearly allocate inventions and software rights.

These issues can directly affect a transaction timetable if discovered late in diligence.

Patentability, patent value and freedom to operate are not the same

A granted patent indicates that the application matured into an enforceable right. It does not by itself establish commercial value, and it does not guarantee freedom to commercialize the product without infringing third-party rights.

An investment-oriented IP review therefore asks additional questions: Is the market problem significant? Can competitors design around the claims? Does the remaining patent term match the commercial growth period? Does the actual product fall within the claims? Are there third-party rights that may restrict commercialization? Can the portfolio expand into future products and overseas markets?

These questions should not be collapsed into a single vague concept of “patent value.”

Build a one-page IP map before the application

A company can start with a simple internal map linking five elements: current and future products; the key technical differentiator of each product; the patents, applications, designs, trademarks or trade secrets protecting that differentiator; identified protection gaps; and the next action, such as follow-on filing, foreign filing, FTO analysis, assignment or contract cleanup.

This one-page exercise often reveals whether the company’s investment narrative is actually supported by its IP assets.

Treat the support program as preparation for diligence

Even if a company receives consulting or an investment feasibility diagnosis through a support program, an actual investor may require much more detailed evidence. Companies can use the application process as a trigger to organize a basic IP data room, including registration and filing records, ownership and assignment documents, material prosecution history, licenses, employee-invention documentation, foreign filings and significant competitive patent analysis.

Connect the patent portfolio to the commercialization story

For investment or commercialization review, a long list of patent numbers is less useful than a clear explanation of how each key right supports a real product, function, process or revenue opportunity. Map a small number of core patents to each product, explain the protected feature in plain language, align the IP with development and market-entry milestones, identify what competitive differentiation the rights protect, and confirm ownership where universities, employees or development partners are involved. This turns the portfolio from a list of registrations into evidence supporting the commercialization plan.
