PCT 국제출원 후 International Search Report(ISR)와 Written Opinion을 받으면, 출원인은 선행기술 결과를 보면서 향후 국가단계 전략을 다시 설계하게 됩니다. 이때 자주 검토하는 절차 중 하나가 PCT Article 19에 따른 청구항 보정입니다.

Article 19는 국제조사보고서를 받은 출원인에게 국제단계에서 청구항을 한 번 보정할 기회를 줍니다. 다만 “명세서 전체를 고쳐 국제출원을 다시 쓰는 절차”는 아닙니다.

1. Article 19로 무엇을 바꿀 수 있나요?

Article 19의 핵심은 claims, 즉 청구항입니다. 국제조사 결과에서 특정 청구항이 신규성 또는 진보성 측면에서 문제가 있다고 지적됐을 때, 선행기술과 구별되는 특징을 청구항에 반영하는 방안을 검토할 수 있습니다.

반면 설명서와 도면을 함께 자유롭게 보정하는 절차는 아닙니다. 명세서·도면까지 보정할 필요가 있거나 심사관과의 추가 국제예비심사 과정에서 보정을 검토하려면 Chapter II와 Article 34가 더 적절한지 비교해야 합니다.

2. 신규사항을 추가할 수는 없습니다

Article 19(2)는 보정이 최초 국제출원의 disclosure를 넘어서는 내용을 포함해서는 안 된다고 규정합니다. 즉, 국제조사에서 문제가 드러났다고 해서 원래 명세서에 없던 새 기술구성을 뒤늦게 청구항에 넣을 수는 없습니다.

따라서 좋은 PCT 명세서는 국제조사 이후 보정전략까지 고려해 다양한 실시형태와 fallback position을 처음부터 충분히 담아두는 것이 중요합니다.

3. 정확한 제출기한은 언제인가요?

PCT Rule 46.1에 따르면 Article 19 보정기한은 다음 둘 중 더 늦게 만료되는 날입니다.

  • 국제조사기관이 ISR을 송부한 날부터 2개월
  • 우선일부터 16개월

보정서는 국제사무국(International Bureau)에 직접 제출합니다. WIPO는 기한이 지난 뒤 도착한 보정도 국제공개를 위한 기술적 준비가 완료되기 전에 접수되면 마지막 날에 접수된 것으로 취급될 수 있다고 규정하지만, 이를 전제로 늦게 제출하는 전략은 피하는 것이 좋습니다.

4. Article 19 보정을 하면 Written Opinion이 자동으로 바뀌나요?

그렇게 단순하지 않습니다. Article 19 보정을 제출한다고 해서 국제조사기관이 자동으로 두 번째 국제조사를 하거나 기존 Written Opinion을 다시 작성하는 것은 아닙니다. WIPO도 Article 19 보정 후 ISA가 두 번째 국제조사를 실시하지 않는다고 설명합니다.

5. Article 19와 Article 34의 차이

Article 19는 기본적으로 청구항 보정에 초점이 있고 국제사무국에 제출합니다. 반면 Article 34 보정은 Chapter II 국제예비심사 절차에서 청구항뿐 아니라 설명서와 도면에 대해서도 보정을 검토할 수 있습니다.

Article 19 보정은 국제공개되는 청구항을 정리하는 실익이 있을 수 있습니다. Article 34는 국제예비심사기관(IPEA)이 보정과 주장을 검토하는 절차와 연결됩니다.

어느 절차가 더 적절한지는 단순히 “더 많이 고칠 수 있는 절차”를 고르는 문제가 아닙니다. 비용, 일정, 목표 국가, 국제단계에서 추가 검토를 받을 실익을 함께 봐야 합니다.

6. Article 19가 특히 실익이 있는 경우

  • 독립청구항의 문제점이 명확하고 원명세서에 좋은 보정근거가 있는 경우
  • 국제공개되는 청구항을 정리해 투자자·라이선시·해외대리인에게 더 명확한 권리구조를 보여주고 싶은 경우
  • 다수 국가단계에서 공통으로 사용할 기본 청구항 세트를 미리 다듬고 싶은 경우
  • 선행기술과 구별되는 핵심 특징을 청구항에 반영하더라도 사업상 의미 있는 권리범위가 남는 경우

반대로 국가별 법리 차이가 크거나, 설명서 보정과 추가 의견제출이 핵심이라면 다른 전략이 더 적절할 수 있습니다.

7. Article 19를 하지 않는 것이 더 나은 경우도 있습니다

국제조사 결과가 부정적이라고 해서 Article 19 보정을 기계적으로 제출할 필요는 없습니다. 너무 이른 단계에서 청구항을 과도하게 좁히면 국가단계에서 필요한 협상범위를 스스로 줄일 수 있습니다.

또한 보정 후에도 사업 핵심제품을 제대로 보호하지 못하거나, 국가별로 서로 다른 청구항 전략이 필요한 경우라면 국제단계에서 하나의 공통 보정안을 만드는 실익이 작을 수 있습니다.

8. 국가단계 비용을 쓰기 전에 할 일

PCT 국제단계의 목적은 “국제특허를 받는 것”이 아니라 각국 진입 전 시간과 정보를 확보하는 데 있습니다. ISR을 받은 뒤 Article 19 보정 여부를 판단할 때는 등록가능성뿐 아니라 실제 제품, 경쟁사, 투자계획, 진입국가 우선순위를 함께 봐야 합니다.

When and Why Should You File an Article 19 Claim Amendment After the PCT International Search Report?

After receiving the International Search Report (ISR) and the Written Opinion in a PCT application, applicants often reassess claim scope before spending substantial money on national-phase entries. One available international-phase tool is an amendment under PCT Article 19.

Article 19 gives the applicant one opportunity to amend the claims after the international search. It is not a general mechanism for rewriting the entire description and drawings.

1. What can be amended under Article 19?

Article 19 is focused on the claims. If the search report identifies a novelty or inventive-step problem, the applicant may consider incorporating a feature that distinguishes the claimed invention from the cited prior art, provided the original application supports that feature.

Article 19 is not the procedure for freely amending the description and drawings. If amendments to those parts are important, or if the applicant wants amendments and arguments to be considered in international preliminary examination, Chapter II and Article 34 should be compared.

2. New matter cannot be added

Article 19(2) does not permit an amendment that goes beyond the disclosure in the international application as originally filed.

A negative search result therefore does not allow an applicant to add a newly developed technical feature that was absent from the original application and preserve the original filing position for that new subject matter.

This is one reason careful PCT drafting should include meaningful fallback positions, alternative embodiments, technical effects and variations that may support later claim amendments.

3. What is the exact Rule 46.1 deadline?

PCT Rule 46.1 sets the Article 19 deadline as the later of:

  • two months from the date the International Searching Authority transmits the ISR; or
  • 16 months from the priority date.

The amendment is filed directly with the International Bureau, not with the receiving Office or the International Searching Authority.

Rule 46.1 also provides a limited safeguard for an amendment received after the applicable deadline but before technical preparations for international publication have been completed. That safeguard should not be treated as a filing strategy; the normal deadline should be calendared and met.

4. Does an Article 19 amendment automatically change the Written Opinion?

No. Filing amended claims under Article 19 does not cause the International Searching Authority to conduct a second international search, nor does it automatically produce a revised Written Opinion.

WIPO explains that Article 19 amendments are published by the International Bureau, while the ISA does not perform another international search. If the applicant wants amended claims and substantive arguments considered in the international phase, a Chapter II demand and Article 34 strategy may be appropriate.

5. Article 19 versus Article 34

Article 19 is primarily a claim-amendment procedure filed with the International Bureau. Article 34 operates in Chapter II international preliminary examination and can involve amendments to the claims, description and drawings, subject to the applicable PCT requirements.

Article 19 can be useful where the applicant wants a revised claim set reflected in the international publication. Article 34 is connected to examination by the International Preliminary Examining Authority and may be more useful where the applicant wants additional international-phase review of amendments and arguments.

The choice is not simply about which procedure permits more editing. Cost, timing, target jurisdictions, the seriousness of the search objections, and the practical value of further international examination all matter.

6. When can Article 19 be strategically useful?

It may be useful where:

  • a problem in an independent claim is clear and the original specification contains strong support for a fallback position;
  • a revised claim set would present the invention more clearly to investors, licensees or foreign associates when the application is published;
  • the applicant wants a common baseline claim set before entering several national phases; or
  • a prior-art distinction can be added while preserving commercially meaningful scope.

The important question is not whether a claim can be narrowed, but whether the amended claim would still protect what matters in the real product and market.

7. When might it be better not to file an Article 19 amendment?

A negative ISR or Written Opinion does not mean an Article 19 amendment should be filed automatically. An unnecessarily narrow international amendment can reduce strategic flexibility before national prosecution begins.

If jurisdictions require materially different claim strategies, if description amendments are central to the response, or if the available fallback scope no longer protects the commercial product, another approach may be better.

8. Review the business case before national-phase spending

The PCT international phase does not itself grant an “international patent.” Its strategic value is that it provides time and information before country-by-country costs are incurred.

When deciding whether to use Article 19, review the ISR, Written Opinion, cited prior art, original specification, current product, competitor patents, target-country business plan and national-phase budget together. A technically possible amendment may still be a poor commercial amendment if competitors can easily design around it or if the resulting claim no longer covers the product roadmap.
