미국·유럽·중국·일본 등 여러 국가의 국내단계 진입을 앞두고 있다면 “이 상태로 각국에 들어가면 모두 거절되는가”, “국가단계 비용을 쓰기 전에 포기해야 하는가”, “지금 보정하면 의미가 있는가”가 실제 의사결정 문제가 됩니다.
결론부터 말하면 PCT Written Opinion이 부정적이라는 이유만으로 각국 특허가 자동으로 거절되는 것은 아닙니다. WIPO의 PCT 가이드라인은 국제조사와 국제예비심사 결과가 국가 또는 지역 특허청의 실체심사를 법적으로 구속하지 않는다고 설명합니다.

1. X·Y 기호보다 어느 청구항에 어떤 논리가 적용되었는지 보세요
국제조사보고서에서 선행문헌 기호만 보고 “X가 있으니 끝났다”고 판단하면 안 됩니다. Written Opinion에서 청구항별로 다음을 읽어야 합니다.
- 신규성이 부정된 청구항
- 진보성이 부정된 청구항
- 하나의 문헌인지 여러 문헌의 결합논리인지
- 독립청구항과 종속청구항의 판단 차이

WIPO 가이드라인상 Written Opinion은 신규성·진보성·산업상 이용가능성뿐 아니라 명확성, 기재지원 등도 다룰 수 있습니다. 따라서 “부정적”이라는 한 단어보다 어떤 이유로 어느 청구항이 문제인지를 구조화해야 합니다.
2. 국제조사 의견은 중요하지만 국가단계 심사청을 구속하지 않습니다
최종 등록 여부는 각 국가 또는 지역청이 자국법에 따라 판단합니다. WIPO는 국가·지역단계 관청이 국제조사 또는 국제예비심사 결과에 구속되지 않는다고 설명합니다.
같은 PCT 출원이라도 국가별 결과가 달라질 수 있습니다.
- 어떤 국가는 국제조사 논리를 그대로 받아들일 수 있습니다.
- 다른 국가는 추가 선행문헌을 찾을 수 있습니다.
- 동일 문헌에 대한 진보성 판단이 다를 수 있습니다.

따라서 Written Opinion이 좋지 않더라도 목표국의 법리와 심사실무에서 실제로 극복 가능한지를 별도로 봐야 합니다.

3. ‘반박 가능한 문제’와 ‘권리범위를 바꿔야 하는 문제’를 나눠야 합니다
부정적 의견에 대한 대응은 크게 두 방향입니다.
첫째는 현재 청구항을 유지하면서 인용문헌과 실제 발명의 차이를 설명하는 것입니다. 인용문헌이 필요한 구성요소를 개시하지 않거나, 문헌을 결합할 기술적 근거가 부족하거나, 발명의 효과가 통상의 설계변경을 넘어선다는 논리를 검토할 수 있습니다.
둘째는 청구항을 보정해 선행기술과의 차이를 더 명확하게 만드는 것입니다.
그러나 보정은 단순히 청구항을 좁히는 작업이 아닙니다. 실제 제품과 경쟁사 대응에 필요한 권리범위를 유지하면서 선행기술을 피해야 합니다. 등록만을 위해 너무 좁은 청구항으로 가면 경쟁제품이 쉽게 회피할 수 있습니다.
4. Article 19와 Chapter II의 Article 34는 전략적으로 구분해야 합니다

각 국가에 대해 다음을 질문해 볼 수 있습니다.
- 실제 매출 또는 시장진입 계획이 있는가
- 주요 경쟁사나 제조사가 있는 국가인가
- 투자자·라이선스 상대방·고객이 현지 권리를 요구하는가
- 제조국과 판매국이 다른 구조인가
- 침해를 실제로 탐지하고 집행할 수 있는가
- 제품수명과 특허획득 예상기간이 맞는가
“PCT를 냈으니 주요국은 모두 들어가야 한다”기보다 사업상 의미가 있는 국가와 청구항 전략을 함께 고르는 것이 중요합니다.

6. 좋은 국제조사 결과라도 모든 국가에 갈 이유는 없고, 나쁜 결과라도 모두 포기할 이유는 없습니다
PCT Written Opinion은 의사결정 자료이지 사업전략을 대신 결정하는 문서는 아닙니다.
긍정적 Written Opinion을 받았더라도 시장이 사라졌거나 사업모델이 바뀌었다면 국가단계 진입을 축소할 수 있습니다.
반대로 부정적 의견을 받았더라도 다음과 같은 경우 계속 진행할 가치가 있을 수 있습니다.
- 핵심 인용문헌과 실제 발명의 차이를 설명할 수 있는 경우
- 종속청구항이나 명세서에 유효한 보정근거가 있는 경우
- 중요한 시장에서 사업가치가 큰 경우
- 경쟁사 진입이 빨라 권리확보 필요성이 높은 경우
- 후속제품까지 고려해 권리범위를 재설계할 수 있는 경우
핵심은 “국제조사 결과가 좋다/나쁘다”가 아니라 비용을 투입할 이유와 승산을 국가별로 설명할 수 있는가입니다.
7. 명세서에 보정근거가 없으면 선택지가 크게 줄어듭니다
국제조사 이후 보정은 최초 명세서에 없던 새로운 내용을 자유롭게 추가하는 절차가 아닙니다. 출원 당시 다양한 실시형태, 대체구성, 수치범위, 선택관계와 기술적 효과가 충분히 기재되어 있는지가 중요합니다.
Written Opinion을 받은 뒤 “이 구성을 넣으면 선행기술과 구별되는데 명세서에 없다”는 상황이 생기면 대응범위가 제한될 수 있습니다.

The PCT Written Opinion Is Negative on Novelty or Inventive Step. Should You Abandon Before National Phase Entry?
Receiving a PCT International Search Report and Written Opinion that cites X or Y references against core claims can be unsettling, particularly when national phase entry in the United States, Europe, China, Japan or other major jurisdictions is approaching.
The starting point is important: a negative PCT Written Opinion does not automatically determine the outcome of national or regional prosecution. WIPO’s PCT Guidelines explain that national and regional Offices are not bound by the results of international search or international preliminary examination.
A negative opinion should nevertheless be treated as an early technical and legal warning. It is an opportunity to reassess claims, cited prior art, amendment options, target markets and prosecution budget before substantial national phase costs are incurred.

1. Read the reasoning claim by claim, not just the X, Y or A category
A search-report category does not answer the entire patentability question.
Review which claims are considered not novel, which claims are considered to lack inventive step, whether one reference or a combination is relied upon, whether dependent claims are treated differently, and whether clarity, support, unity or priority issues are also involved.
The correct question is not simply whether the opinion is “negative,” but why each claim is considered deficient and what argument or amendment could address the issue.
2. The international opinion matters, but it does not bind national Offices
The PCT system provides an early assessment of patentability. Grant or refusal remains a matter for each national or regional Office under applicable law.
The same PCT application may therefore develop differently across jurisdictions. One Office may follow the international reasoning, another may find additional prior art, and inventive-step or amendment practice may differ.
WIPO expressly notes that national and regional Offices are not bound by the results of international search or examination: PCT Guidelines – National Phase.
A negative international opinion therefore requires jurisdiction-specific assessment rather than automatic abandonment.
3. Separate issues that can be argued from issues that require claim redesign
Some objections can be addressed by explaining that the cited reference does not disclose a required element, that a proposed combination lacks technical rationale, or that the claimed effect is more than an ordinary design choice.
Other cases require amendment to sharpen the distinction over prior art.
Amendment should not be reduced to narrowing a claim until it becomes allowable. A claim may become patentable but commercially weak if competitors can easily design around it. The objective is to preserve scope that matters to the actual product while creating a credible distinction over the cited art.
4. Article 19 and Chapter II Article 34 should be used strategically
WIPO identifies several options following the search report and Written Opinion: informal comments, Article 19 claim amendments, supplementary international search, a Chapter II demand with arguments and Article 34 amendments, withdrawal, or no further international-phase action before national phase prosecution.
Chapter II allows the International Preliminary Examining Authority to consider arguments and Article 34 amendments when establishing the international preliminary report on patentability.
The question is not whether Chapter II should always be used. Consider whether the objection can realistically be overcome, whether one international response is more efficient than repeated national amendments, whether a more favorable international report has practical value, and whether the cost and deadlines justify the procedure.
5. National phase entry is a business decision as well as a patentability decision
National phase costs increase quickly as jurisdictions are added. Translation, local counsel, filing fees and future prosecution all matter.
For each target country, ask whether there is a real market, whether important competitors or manufacturers are located there, whether investors or licensees expect local rights, whether infringement can realistically be detected and enforced, and whether the commercial life of the product justifies the prosecution timeline.
Rather than entering every major jurisdiction because a PCT application was filed, companies should align claim strategy with countries that have real commercial relevance.

6. A positive opinion does not justify every country, and a negative opinion does not justify abandoning every country
The Written Opinion supports decision-making; it does not replace business strategy.
A negative opinion may still justify continued prosecution where the cited art can be distinguished, the specification provides strong fallback positions, the market is commercially important, competitor activity makes exclusion rights valuable, or claim scope can be redesigned around next-generation products.
The key question is whether the company can explain why the jurisdiction is worth the cost and why commercially useful protection remains obtainable.
7. If the original specification lacks amendment support, options shrink quickly
International-phase amendment is not a mechanism for adding new matter that was never disclosed in the application as filed.
If a distinguishing feature is identified after the search but was not adequately disclosed in the original specification, amendment options may be limited.
This is why PCT response strategy begins at the drafting stage, with alternative embodiments, fallback positions, numerical ranges, technical effects and commercially meaningful variations.

This converts an abstract question — “Should we enter the national phase?” — into a more useful business question: what claim scope should we pursue, in which countries, at what cost and for what commercial purpose?
Conclusion
A negative PCT Written Opinion on novelty or inventive step does not automatically require abandonment before national phase entry.
International search results are an important early warning, but they do not legally bind national Offices. Applicants may have several international-phase and national-phase response options.
The opposite extreme is also risky: spending heavily across many countries with unchanged claims simply because the PCT route has already been started.
The disciplined approach is to evaluate the objection claim by claim, compare the cited art with the actual product, confirm amendment support, assess commercial value and enforceability by jurisdiction, and then select the countries and claim scope that justify further investment.

Five questions before deciding whether to enter national phase
A negative PCT written opinion is an important early signal, but it is not itself the final decision of every national patent office. Before abandoning a case, review whether the cited art affects all claims equally, whether narrower claims are supported by the original specification, whether amendments remain available without adding new matter, which target markets still justify protection, and whether the expected national-phase and prosecution cost remains proportionate to the commercial value. The practical decision is often claim-by-claim and country-by-country rather than simply “continue” or “abandon.”
