국내 등록특허가 있어도 미국·유럽·중동에서 같은 권리가 생기지 않는다

특허권은 기본적으로 국가별 권리입니다. 한국 등록특허는 한국에서 효력을 가지며, 미국이나 유럽 등 해외시장에서 동일한 배타권이 자동으로 발생하지 않습니다.

G-PASS Is a Market-Entry Platform, Not Automatic International IP Protection

On September 9, 2026, Korea’s Public Procurement Service announced the designation of 55 companies as G-PASS companies for the third quarter of 2026. G-PASS is designed to support promising Korean procurement companies pursuing overseas public procurement opportunities.

For intellectual property strategy, however, companies should distinguish market-access support from territorial IP rights. A Korean patent or trademark does not automatically create equivalent rights in the United States, Europe, the Middle East or other target markets, and G-PASS designation does not change that territorial principle.

Korean patents do not automatically protect overseas sales

Patent rights are territorial. A Korean patent is enforceable in Korea, not automatically in foreign procurement markets. Once target markets become clear, companies should review the priority date of the first Korean filing, remaining foreign-filing opportunities, PCT national-phase deadlines, prior public disclosures, changes made to the commercial product after the first filing, and whether the original specification adequately supports the technology that now matters commercially.

Waiting until an overseas tender appears may be too late for important filing decisions. At the same time, filing indiscriminately in every country is rarely cost-efficient.

Build a market-priority strategy before a country list

An international filing strategy should consider where public tenders are realistically expected, where competitors manufacture or sell, where local distributors or bidding partners operate, and where enforcement would be commercially meaningful.

The purpose is not to collect foreign patents but to place rights where they support revenue, market access and competitive leverage.

Trademarks can become urgent before patents

Overseas procurement exposes company and product names through exhibitions, tender documents, distributor meetings and catalogues. If a similar mark is already registered—or if a local partner files the brand first—the company may face a branding problem even if its technology is strong.

Companies should search key English product names and relevant local-language versions, consider both goods and associated services, and clearly allocate trademark ownership in distributor or agent agreements.

Design rights may protect another layer of the product

For medical devices, robotics, safety equipment, instruments, kiosks and industrial terminals, visual appearance can be commercially important. User interfaces may also justify design protection in appropriate jurisdictions. Patents, designs and trademarks should be treated as complementary rights addressing different forms of imitation.

Owning a patent is not freedom to operate

A company can own valid patents and still infringe third-party rights. Before significant overseas supply, a target-market FTO review may be appropriate, particularly where product specifications are visible and procurement volumes may be meaningful.

Review IP clauses with local bidding partners

When working with agents, distributors, system integrators or joint-venture partners, agreements should distinguish pre-existing technology from newly developed localization results. They should also address ownership of improvements, permitted disclosure of technical materials, trademark use, customer information, domains and post-termination rights.

Use a country-by-country IP matrix

A practical overseas procurement IP matrix can track target market, product, local product name, patent status, trademark status, design needs, competitor/FTO status, certification requirements, local partner, contractual IP ownership and upcoming filing or renewal deadlines.

This turns an international filing list into a business-management tool.

Practical next step

Divide overseas markets into priority, secondary and watch-list markets. For each, determine what will be sold, under what brand, through which bidding structure, and what technology must be disclosed. Then compare that market plan against the company’s current IP portfolio.
