A patent does not become completely immune from challenge simply because registration has been completed.
Korean patent law provides a patent cancellation procedure through which a registered patent may be challenged during a limited period following publication of the registration.
In September 2026, the Intellectual Property Trial and Appeal Board introduced measures intended to improve the quality of patent cancellation proceedings. One of the most important changes for patent owners is that, when the Board considers cancellation appropriate, the reasons and supporting grounds are expected to be communicated more clearly and on a claim-by-claim basis. This should not automatically be regarded as a change that makes patents easier to cancel.
Clearer reasoning may allow a patent owner to understand precisely which claim feature is at issue and to prepare a more focused response or amendment.
At the same time, it increases the practical importance of reviewing post-grant risk on a claim-by-claim basis.
The 2026 measures do not create a new category of cancellation grounds. Their principal purpose is to make the applicant’s grounds and the Board’s reasoning more specific, improving the quality and predictability of the proceeding.
What Is a Patent Cancellation Application?
Under Article 132-2 of the Korean Patent Act, any person may file a patent cancellation application from the date of establishment of the patent right until six months after publication of the patent registration, if the statutory grounds are satisfied.

The Intellectual Property Trial and Appeal Board describes the procedure as a mechanism designed to remove potentially defective patents relatively quickly at an early post-grant stage and thereby improve the stability of registered rights.
According to the Ministry’s September announcement, 196 patent cancellation applications were filed in 2025.
For patent owners, the first six months after publication should therefore be viewed as an important post-grant risk-management period rather than merely an administrative period after receiving a registration certificate.
What Changed in September 2026?
The improvement has two principal components.
1. Patent Owners Will Receive More Specific Cancellation Reasoning
One concern under previous practice was that cancellation grounds submitted by an applicant could sometimes be stated too broadly.
Where a patent owner received a cancellation opinion without sufficiently specific reasoning, it could be difficult to determine how the claims should be defended or whether an amendment was necessary.
The Board has therefore indicated that, when it considers cancellation appropriate, it will distinguish the relevant reasoning and supporting grounds claim by claim so that the patent owner can better understand the basis of the proposed cancellation. A standardized notice of cancellation opinion is also being introduced, together with examiner education and sharing of strong review practices in order to improve consistency.
2. Applicants Will Also Be Encouraged to Present More Specific Grounds
The reform is not directed only at patent owners.
The Intellectual Property Trial and Appeal Board has also issued a Standard Manual for Patent Cancellation Applicants to help applicants structure their cancellation grounds more accurately.
The manual addresses matters including:
- the cancellation procedure
- how to draft cancellation grounds
- comparing claim elements against prior art
- identifying the principal reference where multiple references exist
- identifying differences between the patented invention and prior art
- explaining a motivation or suggestion for combining references
- examples and practical cautions

The practical direction is therefore clear: applicants are being encouraged to structure their case more precisely, while the Board is expected to explain its cancellation reasoning more clearly.
What Does This Mean for Patent Owners?
The immediate practical effect is that the disputed issues may become easier to identify.
If the Board explains which element of which claim is considered problematic and how particular prior art is being applied, a patent owner can focus its response more precisely.
However, that also means the response should be prepared on a claim-by-claim basis.
Each Claim May Present a Different Level of Risk
A patent with ten claims does not necessarily have the same cancellation risk across all ten claims.
A broad independent claim may sit relatively close to prior art, while certain dependent claims contain more specific technical limitations that create stronger distinctions.
When a cancellation opinion is received, the relevant questions may therefore include:
- Which claims are being challenged?
- Which technical elements are considered disclosed or obvious?
- How are the claims related through dependency?
- Which claims are most important commercially?
- Can amendment preserve commercially meaningful scope?
Clearer cancellation reasoning gives the patent owner better information, but it also requires more precise technical and legal analysis of each claim.
Amendment Is Not Simply a Technical Fix
The Korean Patent Act permits a patent owner, subject to statutory requirements, to request correction of the specification or drawings during a patent cancellation proceeding within the prescribed period.

However, the fact that amendment is legally available does not mean that it is always an easy solution.
A narrower claim may overcome a prior-art issue while losing commercial value.
For example, an original claim may cover two major competing products. If an additional technical limitation is added in order to preserve validity but one competing product falls outside the amended claim, the patent may survive legally while becoming less valuable commercially.
A correction strategy should therefore consider at least three issues:
- whether the amendment meaningfully reduces cancellation risk
- whether the amended claim still covers commercially relevant products
- whether the remaining scope remains useful for enforcement, licensing or negotiation
Amendment should therefore be approached as a redesign of enforceable scope rather than a simple drafting exercise.
What Should Be Reviewed Immediately After Registration?
The principal lesson for patent owners should not be to wait until a cancellation application arrives.
The better approach is to review risk during the six-month post-publication period.
Reassess the Registered Claims Against the Closest Prior Art
In addition to the references considered during examination, companies may wish to review newly located material that a competitor could potentially use.
For commercially important independent claims, ask:
- What is the closest prior art?
- What is the actual distinguishing technical feature?
- Could the distinction be characterized as an ordinary modification?
- Is there a realistic rationale for combining multiple prior-art references?
Review the Examination History
Arguments used during prosecution may remain important after grant.
If a particular feature or technical effect was emphasized to obtain registration, later positions should be reviewed for consistency with the earlier prosecution record.
Identify Possible Fallback Positions
Waiting until a cancellation opinion is received to consider possible amendments can create unnecessary time pressure.
Patent owners may benefit from identifying alternative claim positions in advance, particularly for commercially important rights.
The Reform Also Matters When Reviewing Competitor Patents
The 2026 measures are also significant for companies monitoring their competitors.
Where a newly registered competitor patent could interfere with the company’s business, the six-month cancellation period may provide an early opportunity to challenge the right.
The new Standard Manual encourages applicants to go beyond a general statement that a patent is similar to prior technology.
Applicants are expected to structure comparisons between claim elements and references, identify differences, and where relevant explain why multiple references would be combined.
A practical competitor-monitoring process may therefore include:
- monitoring newly registered competitor patents
- recording publication dates
- tracking the six-month deadline
- identifying commercially important claims
- searching relevant prior art
- creating claim-element comparison charts
- evaluating whether cancellation or another procedure is appropriate
