If you find what appears to be a counterfeit version of your brand on an online marketplace or overseas shopping platform, the first steps are to preserve evidence, confirm the scope and territory of your trademark rights, and then decide which combination of reporting, platform takedown, warning, administrative or investigative action, and civil enforcement fits the case. A reporting channel can be useful, but a single report does not automatically remove every listing or automatically produce damages or criminal sanctions.
On September 17, 2026, the Korean Intellectual Property Office, together with the Korea Intellectual Property Protection Agency, promoted the Fake K-Brand Reporting Center, which had been launched in July. The official announcement explains that Korean citizens can report suspected fake K-brand cases discovered at overseas stores or online marketplaces. Reports are reviewed by experts, and meaningful information may be forwarded promptly to the relevant K-brand rights holder, with possible follow-up government support when needed. On the same date, the Korean Intellectual Property Office and the Ministry of Food and Drug Safety also announced a joint-investigation case involving a broker that distributed counterfeit products through Korean online marketplaces.
Core point: A report can start the process, but the trademark owner still needs an enforcement plan. Determine what is actually counterfeit, which trademark in which country applies, who the seller is, and what evidence can be preserved before choosing the takedown and legal measures.
What does the government reporting center actually do?
According to the Korean Intellectual Property Office’s September 17, 2026 announcement, the Fake K-Brand Reporting Center provides an online channel for Korean citizens to report suspected fake K-brand products found in overseas stores and online marketplaces. “It looks cheap and suspicious” is not the same as a legal conclusion of trademark infringement
The first practical discipline is not to label every suspicious listing as a counterfeit immediately. If a non-genuine product bears an identical brand mark and the packaging differs from the authentic product, counterfeiting may appear likely. For enforcement, however, the registered mark, designated goods, mark actually used, manner of sale, territory, and status of the right should still be checked.
Several situations need to be separated.
1. An obvious suspected counterfeit bearing the registered mark
If a non-genuine product uses a mark identical or highly similar to the owner’s registered trademark on identical or similar goods, trademark infringement may be the central issue. Evidence should be preserved before the page disappears, and the owner can then consider platform reporting together with official reporting or other enforcement tools.
2. Different logo but very similar packaging, color scheme, or product appearance
Trademark law may not answer the entire problem. The owner may need to examine whether the word or device mark is legally similar, whether design rights or unfair-competition issues apply, and how the product appearance was copied. Visual resemblance and infringement of a specific registered right are not always the same question.
3. Genuine goods sold by an unauthorized seller
A product should not automatically be called counterfeit merely because the seller is outside the authorized distribution network. Genuine resale, parallel imports, contractual distribution restrictions, alteration, or repackaging can raise issues different from counterfeiting. Product authenticity and trademark infringement should be separated before making accusations or filing reports.
4. Listings on an overseas platform
A Korean trademark registration does not automatically create an identical enforcement right in every country. Trademark rights are territorial. The owner should consider the country of sale and delivery, local registrations, ownership of the relevant rights, platform IP policies, and available local procedures. The Korean reporting center can help identify suspected overseas counterfeiting, but actual takedown or enforcement in a target country may depend heavily on the rights held there.
Do not assume: “We have a Korean registration, so every foreign platform must remove the listing immediately.” Overseas enforcement requires a review of the relevant national rights and platform procedures.
What evidence should be captured immediately?
A common mistake is contacting the seller first and discovering that the page has disappeared before evidence was preserved. Before contact, save the publicly available information in a structured way.

Where possible, preserve the context rather than only a cropped product image. The page, URL, timing, seller identity, and displayed mark should remain connected. If a seller changes accounts, other publicly visible information such as store names, related listings, and shipping information may also help identify patterns.
Whether to purchase a sample depends on the matter. Some platform takedowns may be possible based on the online use of the mark, while authenticity analysis, investigation, or litigation may make a sample important. Products that may present safety risks, such as food, cosmetics, or electrical goods, should not be used merely to test authenticity.
Build a one-page rights chart
After evidence preservation, map the rights to the product. Do not stop at locating one trademark certificate.
- registration number and current status
- whether the registered owner matches the current company
- comparison between the registered mark and the mark shown on the suspected product
- designated goods or services and their relationship to the product
- whether sales are domestic or foreign
- for foreign sales, the local trademark or international registration coverage
- which word, Korean-language, English-language, logo, or device registrations are most relevant
- whether design, patent, copyright, or other rights may also matter
A growing brand may have adopted a new logo while retaining registrations only for an older version, or it may have expanded into products not adequately covered by its original filing plan. Discovery of a counterfeit problem is therefore also a useful time to audit the trademark portfolio.
How should platform takedown, reporting, and legal action be sequenced?
There is no universal order, but several common branches can be distinguished.
A. Immediate sales interruption is the priority
If sales are rapidly increasing, consumer safety may be at issue, and the rights analysis is relatively clear, preserve the evidence first and then use the platform’s IP infringement process promptly. Platforms may require their own forms and supporting documents, so the registration information, proof of ownership, and listing URLs should be accurate.
B. The seller and distribution network need to be identified
Deleting a single listing may only push a repeat seller to another account or platform. Purchase records, shipping labels, packaging, seller information, and relisting patterns may help reveal the distribution chain and support a decision on administrative, investigative, or legal measures.
