English Version
Choosing a brand name is one of the first major decisions a business owner makes. Entrepreneurs often invest substantial time and money in creating logos, packaging, store signs, websites, and promotional materials before launching their businesses.
However, a business may have already registered its trade name, opened a store, and started selling products only to discover that its trademark application cannot be registered.
Business registration and trademark registration are separate legal processes. Registering a business name does not automatically grant exclusive trademark rights.
Under Korean trademark law, an application must satisfy legal requirements relating to distinctiveness, earlier trademark rights, designated goods and services, and other statutory restrictions.
This article examines five major reasons trademark applications may be rejected in South Korea and explains practical measures businesses should consider before investing in a new brand.
1. Conflict With Earlier Trademarks
One of the most common obstacles to trademark registration is the existence of an earlier filed or registered trademark.
Trademark examination does not involve checking only whether two names have exactly the same spelling.
The similarity of trademarks is generally assessed by considering their appearance, pronunciation, and meaning, together with the relevant commercial circumstances and the likelihood of confusion concerning the origin of goods or services.
For example, a business seeking to register a name equivalent to “Sky Garden” might encounter difficulties if an earlier trademark equivalent to “Garden in the Sky” has already been registered for related services.
Although the names are not identical, their pronunciation, meaning, and overall commercial impression may raise a similarity issue.
This is a hypothetical example. The outcome of an actual case depends on the marks, designated goods or services, and relevant market circumstances.
Does a Similar Trademark Always Prevent Registration?
Not necessarily.
Even where two marks are similar, registration may be possible if their designated goods or services are legally dissimilar and no other ground for refusal applies.
Conversely, goods or services assigned to different classification numbers may still be considered similar.
A proper clearance search must therefore examine both the marks and their designated goods or services.
Practical point: An ordinary internet search is not a substitute for trademark clearance. Businesses should review earlier applications and registrations through KIPRIS and assess the relevant goods and services before selecting a brand.
The Korean Intellectual Property Office’s official guidance identifies searching earlier trademarks as an important step before filing.

2. Lack of Distinctiveness
A trademark must be capable of distinguishing one business’s goods or services from those of others.
Under Article 33 of the Korean Trademark Act, certain signs may be refused registration because they lack the required distinctiveness.
Examples include generic names of goods, customary terms, signs that merely describe characteristics such as quality, ingredients, purpose, or origin, and other signs that consumers cannot recognize as identifying a particular commercial source.
For instance, an expression equivalent to “Delicious Coffee,” used in relation to coffee-related goods or services, may raise distinctiveness concerns because it primarily communicates a favorable product characteristic.
Similarly, terms that directly describe a product’s function, ingredients, or intended use may be difficult to register on their own.
Are All Descriptive Expressions Unregistrable?
No.
The overall composition of a mark matters. A combination of words or a distinctive arrangement of verbal and graphic elements may create a different commercial impression.
Nevertheless, adding a simple graphic element does not automatically provide exclusive protection over descriptive wording.
Korean trademark law also recognizes acquired distinctiveness in certain circumstances.
Under Article 33(2), certain marks that initially lack inherent distinctiveness may become registrable for relevant goods if, through use before filing, consumers have come to recognize them as indicating a particular commercial source.
Establishing acquired distinctiveness may require evidence of sales, advertising, duration and extent of use, and consumer recognition.
Trademark Act, Article 33 – Requirements for trademark registration
Key takeaway: A memorable marketing name is not necessarily a legally strong trademark. Distinctiveness and earlier trademark rights should be evaluated during the naming process, not only after the brand has been launched.
3. Incorrect Selection of Designated Goods and Services
Trademark registration does not automatically grant exclusive rights to use a brand name across every industry.
Applicants must specify the goods or services for which protection is sought.
These designated goods and services are central to both the examination of earlier trademark conflicts and the eventual scope of protection.
Consider a café that sells prepared beverages, packaged coffee beans, branded mugs, and merchandise through an online store.
The business should consider whether its trademark application adequately covers its present and planned commercial activities.
A registration covering restaurant or café services does not necessarily protect all packaged food products, household goods, or merchandise.
Do Different Classification Numbers Mean There Is No Conflict?
No.
Trademark classes are administrative classification tools. Legal similarity may depend on the nature, purpose, distribution channels, producers, and consumers of the relevant goods or services.
Goods or services in different classes can sometimes be considered similar.
Applicants should therefore select designated goods and services based on their business activities and realistic expansion plans.
Excessively broad or unnecessary designations may increase costs and create avoidable examination issues.
At the same time, designations that are too narrow may fail to protect commercially important activities.
The objective is not simply to select as many classes as possible, but to obtain commercially appropriate protection.
4. Business Registration Does Not Establish Trademark Ownership
Business owners sometimes assume that obtaining a business registration certificate gives them exclusive rights to the business name.
However, business registration, corporate name registration, domain name registration, and trademark registration serve different legal purposes.
Earlier registration of a business name does not automatically override an earlier trademark right held by another party.
Likewise, securing a domain name or social media account does not guarantee trademark registrability.
What If the Business Is Already Using the Brand?
Prior use can be relevant in certain legal circumstances, but it does not automatically resolve every conflict with earlier trademark rights.
A business that has already invested in signage, product packaging, advertising, or a website may face significant costs if a trademark conflict is discovered later.
Those costs can include replacing signs, redesigning packaging, changing promotional materials, and rebuilding brand recognition.
For that reason, businesses should consider trademark clearance before making substantial investments in brand identity.
Common misconception: “I registered my business first, so I own the brand.” Business registration and trademark protection involve different requirements and should be evaluated separately.
5. Trademark Coexistence Consent May Offer a Solution
A conflict with an earlier trademark does not always mean that a later applicant must abandon the application.
South Korea introduced a trademark coexistence consent system in May 2024.
Under this system, a later trademark application may be eligible for registration in certain circumstances when the relevant earlier trademark owner or applicant provides the required consent.
The system was introduced to address situations in which businesses could otherwise be prevented from registering marks because of earlier similar marks, despite the parties being willing to coexist.
However, consent is not a universal solution.
The statutory requirements and exclusions must be examined carefully. Certain situations, including those involving marks and designated goods that are both identical, are not covered by the general consent mechanism.
Moreover, consent does not eliminate other independent grounds for refusal, such as lack of distinctiveness.
The coexistence consent system should therefore be treated as one possible legal option rather than a guarantee of registration.
Official announcement concerning the trademark coexistence consent system
6. Responding to a Trademark Office Action
During examination, an examiner may issue an office action identifying grounds for refusal.
An office action is not necessarily a final rejection.
The applicant should first identify the relevant statutory provision and the precise reasons for the examiner’s objections.
Where the Objection Concerns an Earlier Trademark
The applicant should review the appearance, pronunciation, and meaning of the marks and the similarity of the designated goods or services.
Depending on the circumstances, the applicant may consider written arguments, permissible amendments to designated goods, or the coexistence consent system.
Where the Objection Concerns Distinctiveness
The applicant should assess whether the mark, considered as a whole, possesses sufficient distinctiveness.
Evidence of acquired distinctiveness may be relevant in eligible cases.
However, not every descriptive or generic mark can become registrable merely through the submission of use evidence.
If the mark itself requires substantial modification, a separate new application may need to be considered because amendments are subject to statutory restrictions.
Where the Objection Concerns Designated Goods
The applicant may need to clarify, amend, or delete particular goods or services within the permitted scope.
Such changes may help address the examiner’s objections but may also reduce the commercial scope of protection.
Consequently, any proposed amendment should be evaluated against the applicant’s business plans.
Practical consideration: Responding to an office action is not only about obtaining registration. The response can materially affect the final scope of trademark protection and should be prepared with the business’s commercial objectives in mind.
7. Pre-Filing Trademark Checklist
Before filing a trademark application, a business should consider the following matters:
- Trademark composition: The exact Korean or English wording, numbers, symbols, and graphic elements to be protected.
- Earlier rights: Existing trademark applications and registrations that may conflict with the proposed mark.
- Distinctiveness: Whether the mark is generic, descriptive, customary, or otherwise insufficiently distinctive.
- Designated goods and services: The products and services currently offered.
- Expansion plans: Planned product lines, online sales, franchising, or other business activities.
- Existing use: Signs, packaging, websites, advertisements, and other materials already displaying the mark.
- Ownership: Rights arising from partnerships, commissioned logo designs, licensing arrangements, or other contractual relationships.
A preliminary search can be conducted through the KIPRIS intellectual property search service.
However, interpreting the legal status, filing dates, designated goods, and similarity of earlier marks may require a more detailed professional assessment.
8. Frequently Asked Questions
If KIPRIS Shows No Identical Trademark, Is My Brand Registrable?
Not necessarily. A differently spelled mark may still be similar in pronunciation or meaning. Other grounds for refusal, including lack of distinctiveness, may also apply.
Can Adding a Logo Avoid a Conflict With an Earlier Trademark?
Not automatically. A composite mark is assessed in its entirety, but a prominent verbal element may remain relevant to the similarity analysis.
Must I Change My Brand If My Trademark Application Is Refused?
The answer depends on the grounds for refusal and the procedural stage.
Possible responses may include arguments, permissible amendments, coexistence consent, a new application, or brand modification.
Should I File Before Launching My Business?
Early clearance and filing are generally worth considering before major investments are made in branding. The appropriate filing strategy depends on the planned goods and services and the applicant’s commercial objectives.
9. Conclusion – Trademark Protection Begins With Brand Selection
Trademark registration may be refused for several reasons, including conflicts with earlier marks, insufficient distinctiveness, unsuitable designated goods or services, and other statutory restrictions.
A business should therefore consider legal registrability and the commercially appropriate scope of protection when developing a brand.
Discovering a trademark conflict after launching a product or opening a store can result in substantial costs and disruption.
