해외 진출 전에 우리 상표를 다른 사람이 먼저 등록했다면? 중국·동남아 진출 기업이 출원 전에 확인할 것

해외 진출 전에 현지에서 동일·유사 상표가 이미 출원·등록돼 있다면 한국 상표권만으로 해결되지 않습니다. 상표권의 속지주의, 중국의 선출원 원칙, 선행상표 조사, 이의·무효 가능성, 현지 신규출원과 Madrid System 활용을 시장별로 나눠 검토해야 합니다.

해외 진출을 준비하면서 현지 상표검색을 해보니 우리 회사와 같거나 매우 비슷한 상표가 이미 출원 또는 등록되어 있는 경우가 있습니다. 국내에서 오랫동안 사용했고 한국에 상표등록까지 해두었더라도, 그 사실만으로 중국·베트남·태국·인도네시아·싱가포르 등 다른 국가에서 동일한 권리가 자동으로 생기는 것은 아닙니다.

핵심은 “우리 상표가 유명하니 되찾을 수 있겠지”라고 가정하는 것이 아니라, 목표국에서 누가 어떤 표장을 어떤 상품·서비스에 언제 출원했고 현재 절차가 어느 단계인지부터 확인하는 것입니다.

한국 상표가 있으면 해외에서도 보호되는 것 아닌가요?

상표권은 기본적으로 속지주의(territoriality)에 따라 국가 또는 지역별로 성립합니다. WIPO도 해외 상표보호에 대해 국가별 출원, 지역 단위 출원 또는 Madrid System을 이용할 수 있다고 설명하고 있으며, 각 지정국의 국내법에 따라 실제 보호범위와 등록 가능성이 결정됩니다.

따라서 한국에서 상표를 먼저 사용하고 등록했다고 해도 해외 목표시장에서 별도의 권리를 확보하지 않았다면, 현지에서 제3자의 선출원이 문제될 수 있습니다. 반대로 Madrid 국제등록을 이용했다고 하더라도 지정국마다 실체심사를 거치므로 “국제등록 하나면 전 세계에서 자동 보호된다”는 의미도 아닙니다.

중국은 특히 출원 시점을 왜 먼저 봐야 하나요?

중국 국가 지식산권국(CNIPA)은 2026년 동일일 출원 절차 안내에서도 중국 상표등록이 선출원 원칙(first-to-file principle)을 기본으로 한다고 명시하고 있습니다. 같은 날 동일·유사 상표가 동일·유사 상품에 출원된 경우에는 사용관계까지 추가로 보지만, 일반적으로는 누가 먼저 출원했는지가 매우 중요합니다.

그래서 중국 진출을 준비하면서 브랜드 공개, 전시회 참가, 현지 유통상 접촉, 크라우드펀딩, 온라인 판매를 먼저 시작하고 상표출원을 뒤로 미루면 불필요한 위험이 커질 수 있습니다. 실제 문제를 발견한 뒤에는 “우리가 먼저 한국에서 썼다”는 사실만 확인할 것이 아니라 중국 내 선출원자의 출원일, 지정상품, 출원인, 현재 등록상태를 함께 봐야 합니다.

먼저 확인할 것은 ‘상표 이름’보다 권리의 정확한 범위입니다

검색화면에서 비슷한 이름 하나가 보인다고 바로 포기할 필요도 없고, 반대로 이름이 조금 다르다고 안심할 수도 없습니다. 최소한 다음을 확인해야 합니다.

  1. 표장 자체 — 문자, 로고, 한자·현지어 표기, 발음과 의미가 어느 정도 유사한지
  2. 상품·서비스 — 실제 판매제품과 상대방 지정상품이 동일·유사한지
  3. 출원·등록일 — 우리의 국내 최초 출원일, 해외 우선권 가능기간, 상대방 출원일이 어떻게 되는지
  4. 권리상태 — 출원 중인지, 공고 중인지, 등록됐는지, 갱신 또는 취소 상태인지
  5. 출원인 관계 — 과거 대리점, 유통상, 협력사, 전 직원처럼 우리 브랜드를 알고 있던 주체인지
  6. 사용증거 — 우리 브랜드의 해외사용, 광고, 전시, 거래, 웹사이트·SNS 노출 기록이 언제부터 존재하는지

이 정보를 먼저 정리해야 이의신청, 무효·취소절차, 협상, 공존, 신규 브랜드 출원 같은 선택지를 비교할 수 있습니다.

상대방이 먼저 등록했다면 무조건 끝난 건가요?

그렇지는 않습니다. 다만 가능한 대응은 국가와 사건 단계에 따라 크게 달라집니다. 일부 국가에서는 출원공고 단계에서 이의신청을 할 수 있고, 이미 등록된 뒤에는 무효 또는 취소절차가 문제될 수 있습니다. 악의적 선점, 대리인·거래관계, 주지·저명성, 실제 사용 여부 등이 쟁점이 되는 경우도 있습니다.

중요한 것은 인터넷에서 “상표 브로커는 다 취소할 수 있다”거나 “몇 년 사용 안 했으면 자동으로 없어진다”는 식의 단순한 결론을 그대로 적용하지 않는 것입니다. 각국 법률의 요건, 제척기간·제출기한, 증거형식과 번역·공증 요구가 다를 수 있기 때문에 현지 절차를 기준으로 검토해야 합니다.

선점상표가 있어도 새 출원 전략을 같이 검토해야 합니다

분쟁대응만 하다가 실제 사업용 권리확보를 놓치는 경우가 있습니다. 기존 선점상표의 취소나 무효가 가능하더라도 시간이 걸릴 수 있으므로, 사업일정과 함께 다음 대안을 병행해서 검토할 필요가 있습니다.

  • 영문 브랜드뿐 아니라 현지어 명칭도 별도로 출원할지
  • 로고와 문자상표를 어떤 순서로 확보할지
  • 현재 제품 외에 향후 확장상품까지 어느 범위로 지정할지
  • 핵심국은 개별출원하고 나머지 국가는 Madrid System으로 묶는 것이 효율적인지
  • 현지 판매 전 포장, 도메인, 온라인몰 계정, 유통계약의 브랜드 표기를 어떻게 통일할지

WIPO의 Madrid System은 하나의 국제출원 절차를 통해 여러 회원국에 보호를 요청하고 포트폴리오를 중앙관리할 수 있는 장점이 있습니다. 다만 지정국별 실체심사는 그대로 존재하므로 선행상표 충돌 가능성은 출원 전에 따로 조사해야 합니다.

동남아는 ‘한 번에 동남아 상표’로 처리되는 것이 아닙니다

중국과 마찬가지로 동남아 시장도 국가별 법률과 심사·이의 절차를 확인해야 합니다. 싱가포르, 베트남, 태국, 인도네시아 등은 하나의 단일 상표권으로 묶여 있는 시장이 아니므로, 실제 진출국·제조국·유통거점·온라인 판매지역을 기준으로 우선순위를 정하는 편이 실무적입니다.

예를 들어 제조는 베트남, 판매는 태국과 싱가포르, 온라인 수출은 인도네시아까지 예정되어 있다면 단순히 매출이 가장 큰 한 국가만 보는 것이 아니라 제조·유통·판매 과정에서 브랜드가 실제 노출되는 위치를 함께 봐야 합니다.

해외 진출 전에 기업이 준비할 상표 체크리스트

해외진출을 확정한 뒤 상표조사를 시작하기보다 브랜드와 제품명이 정해지는 단계에서 아래 자료를 한 번에 정리하면 좋습니다.

  • 한국 상표출원·등록번호와 최초 출원일
  • 실제 사용 중인 문자·로고·한글·영문·현지어 버전
  • 현재 판매상품과 향후 2~3년 내 확장예정 상품
  • 목표국별 진출 시점과 유통구조
  • 해외 전시회, 박람회, 크라우드펀딩, 온라인 공개 예정일
  • 현지 파트너·대리점과 체결한 계약 및 브랜드 사용조항
  • 선행상표 검색결과와 충돌 후보 목록
  • Madrid 국제출원과 개별국 출원의 비용·일정 비교

특히 상표출원보다 공개가 먼저 되는 일정이 있는지 확인해야 합니다. 제품 공개 직전이 아니라 브랜드 선정 단계에서 검색과 출원 우선순위를 정하면 선택지가 훨씬 많아집니다.

이미 선점 사실을 발견했다면 대응 순서

첫째, 상대방의 정확한 권리상태와 지정상품을 공식 데이터베이스에서 확인합니다. 둘째, 우리 회사의 국내외 사용·거래·광고·전시 증거를 날짜순으로 정리합니다. 셋째, 목표국에서 이의·무효·취소·협상 중 어떤 절차가 가능한지 확인합니다. 넷째, 실제 사업을 멈추지 않기 위해 대체상표 또는 추가출원 전략을 동시에 검토합니다.

상표 분쟁에서 가장 비싼 실수는 문제를 발견한 뒤에도 “나중에 매출이 커지면 해결하자”며 시간을 보내는 것입니다. 해외시장에서는 출원일과 절차기한이 중요한 경우가 많으므로 발견 즉시 권리상태를 고정해 확인하는 것이 우선입니다.

What If Someone Registered Your Trademark Before You Entered China or Southeast Asia?

Finding an earlier identical or similar trademark in a target market does not mean the issue can be solved simply by pointing to a Korean registration. Trademark rights are territorial. WIPO explains that brand owners seeking protection abroad generally use national, regional or Madrid System routes, and the domestic law of each target market determines whether protection is granted.

The first task is to identify exactly who filed what mark, for which goods or services, on what date, and at what procedural stage.

Why filing timing matters particularly in China

China’s National Intellectual Property Administration states that China applies the first-to-file principle for trademark registration, supplemented by a first-to-use rule in the special case of same-day applications. This makes filing chronology a central issue when a company discovers that another party has already applied for its brand.

A Korean filing or long-standing Korean use may be important evidence in a broader dispute, but it does not by itself create a Chinese trademark right. Companies should compare the third party’s filing date and goods/services with their own filing history, planned market entry, and any evidence showing prior commercial relationships or knowledge of the brand.

Do not assess the problem by the name alone

An earlier mark should be reviewed for the mark itself, the covered goods and services, application and registration dates, current legal status, applicant identity, and any connection between the applicant and your company. A distributor, former partner, employee or other party that previously knew the brand may raise different issues from an unrelated earlier applicant.

Likewise, a similar-looking mark is not automatically fatal. The scope of the earlier right and the relevant national rules must be examined before deciding whether the conflict blocks use or registration.

An earlier registration does not always end the analysis

Depending on the country and procedural stage, possible routes may include opposition, invalidation or cancellation proceedings, negotiation, coexistence arrangements, a new filing strategy, or a brand modification. Bad-faith filing, prior relationships, reputation and actual use can matter in some jurisdictions, but the requirements and deadlines differ significantly by country.

For that reason, generic online statements such as “a trademark squatter can always be cancelled” or “an unused registration disappears automatically” should not be treated as universal rules. The relevant national procedure and evidence requirements should control the analysis.

Build the new filing strategy at the same time

Dispute strategy should not prevent the company from securing the rights it still needs for business. Review whether to file the English word mark, local-language name and logo separately; whether future goods or services need coverage; and whether key countries should be filed nationally while additional markets are designated through the Madrid System.

The Madrid System can simplify multi-country filing and portfolio management, but each designated office still conducts substantive examination under its own domestic law. Earlier-mark searches therefore remain important before filing.

Southeast Asia is not one trademark jurisdiction

Singapore, Vietnam, Thailand, Indonesia and other Southeast Asian markets have their own trademark laws and procedures. Priorities should reflect where the company manufactures, distributes, sells and promotes its products, not merely the country with the highest expected sales.

If manufacturing occurs in one country, distribution in another and e-commerce sales in several more, the trademark plan should account for the actual commercial footprint of the brand.

Practical pre-entry checklist

Before launching abroad, organize your Korean filing details, all versions of the mark, current and planned goods/services, country-by-country launch dates, planned public disclosures, distributor agreements, earlier-mark search results and a comparison of national versus Madrid filing routes.

If an earlier filing has already been found, verify its official status, preserve your own dated evidence, identify available opposition or invalidation routes, and prepare a parallel filing or alternative-brand plan. Delay can reduce options where statutory deadlines apply.

Preserve the evidence before deciding how to respond

When a conflicting trademark is found abroad, collect the factual record before contacting the registrant. Useful evidence includes the earliest brand-use records, your filing history, the other party’s filing date and specification, communications arising from local distribution or negotiations, and dated evidence of use on websites, packaging, exhibitions and social media. That record supports a more disciplined assessment of opposition, cancellation, invalidation, coexistence or negotiated solutions under the relevant local law.
