English Version

Launching a new product is an important milestone for inventors, designers, startups, and manufacturers. Businesses often focus on completing prototypes, preparing product photography, setting up online stores, and arranging marketing campaigns.

However, design registration is sometimes postponed until after the product reaches the market.

This approach can create legal risks because public disclosure before filing may affect the novelty of a design under Korean design protection law.

Even when a company developed a product independently, its own disclosure may become relevant during examination.

This article explains the importance of filing before launch, the legal requirements for design registration, possible relief after disclosure, and practical steps for protecting product appearance.

1. What Does Design Registration Protect?

Design rights primarily protect the visual appearance of a product rather than its underlying technical operating principles.

Under the Korean Design Protection Act, protected subject matter may include the shape, pattern, color, or combination of these features in an article, as well as qualifying image designs.

Examples may include distinctive cosmetic containers, furniture designs, lighting fixtures, electronic device cases, and product packaging.

A product does not necessarily need an innovative technical function to qualify for design protection.

Conversely, a product’s technical innovation does not automatically mean that its appearance is protected by design rights.

How Is Design Registration Different From a Patent?

A patent protects qualifying technical inventions, while design registration protects qualifying visual designs.

For example, a suitcase with a new locking mechanism may involve patentable technical features, while its distinctive external appearance may be evaluated for design registration.

Both forms of protection may be relevant to the same commercial product.

Key takeaway: Technical features and visual appearance are different forms of intellectual property. A product protection strategy should assess each separately.

2. Why Can Public Disclosure Prevent Design Registration?

Article 33 of the Korean Design Protection Act establishes the requirements for design registration.

As a general rule, a design that was publicly known or publicly worked before filing, disclosed in a publication, or made available to the public through electronic communications may face a novelty objection.

Designs similar to previously disclosed designs may also be affected.

Importantly, a disclosure made by the designer or business itself may create a novelty issue.

What Activities May Count as Public Disclosure?

Relevant activities can include offering products for sale, posting identifiable product photographs on an online store, publishing design images on social media, or displaying products at an exhibition.

Even if no actual sales occur, making the design available to the public may be relevant.

By contrast, disclosure to a limited group subject to genuine confidentiality obligations may require a different assessment depending on the circumstances.

Businesses should therefore control how product images, prototypes, and technical materials are shared before filing.

Can a Product Be Disclosed Without Being Sold?

Yes.

For example, posting detailed photographs of an upcoming product on a public social media account may create a disclosure issue even before commercial sales begin.

The publication date, accessibility, and information shown in the photographs should be reviewed.

Official Korean Design Protection Act, Article 33

3. Is Registration Impossible After Disclosure?

Not necessarily.

Article 36 of the Korean Design Protection Act provides an exception to loss of novelty under specified circumstances.

Where the statutory requirements are satisfied, a person entitled to design registration may be able to rely on the exception for an application filed within 12 months after the relevant disclosure.

However, this does not mean that every public disclosure is harmless for an entire year.

The person responsible for the disclosure, the relationship between the disclosed and filed designs, the filing date, statutory exclusions, and procedural requirements may all be relevant.

Certain disclosures arising from official publication of applications or registrations are excluded from the exception.

Is It Safe to Wait Until the End of the 12-Month Period?

No.

The exception does not automatically move the filing date back to the date of disclosure.

Third-party filings and other legal developments may occur between disclosure and filing.

Furthermore, other countries may apply different disclosure rules and grace periods.

For businesses considering international design protection, filing before public disclosure is generally the more prudent approach.

Official Korean Design Protection Act, Article 36

Important warning: Do not assume that a 12-month grace period guarantees protection. If disclosure has already occurred, preserve evidence of the first disclosure and promptly assess the applicable requirements.

4. Can a Slightly Modified Existing Design Be Registered?

Novelty is not the only requirement for design registration.

The Korean Design Protection Act also restricts registration of designs that a person with ordinary knowledge in the relevant field could easily create from existing designs or widely known visual features.

A design may therefore differ from earlier products but still fail to satisfy the applicable creativity requirement.

For example, a minor decorative change to an ordinary container may not be sufficient, depending on the existing designs and the overall visual impression.

On the other hand, a distinctive arrangement of features may support a different assessment.

How Is Design Similarity Evaluated?

Design similarity is not determined solely by counting differences between individual elements.

The overall visual impression, characteristics of the article, and relevant appearance features must be considered.

Differences in size or minor line placement do not necessarily make designs legally dissimilar.

A proper prior-design search should review not only product photographs but also registered drawings, descriptions, and legal status.

5. Can Only Part of a Product Be Protected?

In appropriate circumstances, partial design protection may be available.

For example, the distinctive features of a product may be concentrated in a handle, lid, button arrangement, or a particular surface configuration.

A partial design application can be considered where the relevant statutory requirements are satisfied.

However, the protected portion must be properly identified through the application drawings and descriptions.

Simply cropping a product photograph is not equivalent to preparing an appropriate partial design application.

Should Every Design Variation Be Filed?

Not necessarily.

A business may prioritize the design selected for launch, the visual features most likely to be copied, and commercially significant variations.

Where a new design is similar to the applicant’s basic design, the related design system may be relevant.

Under Article 35 of the Korean Design Protection Act, qualifying related designs may be filed within three years from the filing date of the basic design, subject to statutory requirements.

The relationship between the basic design and related designs should therefore be assessed before filing.

Practical point: Evaluating complete designs, partial designs, and commercially significant variations can provide a more targeted strategy than filing every preliminary concept.

6. How Should Drawings and Photographs Be Prepared?

A design application must identify the design for which protection is sought.

Depending on the type of design, views such as perspective, front, rear, left, right, top, and bottom views may be relevant.

The appropriate presentation method depends on the design and the applicable filing requirements.

Are Product Photographs Sufficient?

Photographs may be used in suitable circumstances, but the design must be shown clearly and consistently.

Distortion caused by camera angles, shadows, reflections, background objects, or inconsistent views may create uncertainty about the claimed appearance.

Accurate drawings or properly prepared photographs are therefore important.

Because new design features generally cannot be freely introduced after filing, the initial application materials should be prepared carefully.

7. What Are the Risks of Launching Without Design Registration?

Launching a product without design registration is not automatically unlawful, and it does not necessarily eliminate every possible form of legal protection.

Other laws, including unfair competition rules, may be relevant in certain circumstances.

However, without a registered design right, a business cannot rely on the exclusive rights arising from that registration.

This may affect its response when competitors introduce products with similar appearances.

Does Design Registration Prevent Every Copy?

No.

The scope of a registered design right generally extends to the registered design and legally similar designs, but infringement depends on the specific registered scope and the appearance of the accused product.

The validity of the registration, relevant prior designs, and possible limitations must also be considered.

The quality and scope of the original application are therefore important.

8. Pre-Launch Design Filing Checklist

Before publicly launching a product, consider the following:

  • Final appearance: Has the intended commercial design been sufficiently finalized?
  • Prior-design search: Are there earlier similar registered or publicly disclosed designs?
  • Disclosure history: Has the product appeared on social media, in catalogues, at exhibitions, or in online stores?
  • First disclosure date: If disclosed, is reliable evidence available?
  • Scope of protection: Should the application cover the whole product, a distinctive part, or multiple variations?
  • Drawings: Are the appearance features accurately and consistently shown?
  • Ownership: Are the rights of employees, contractors, and joint designers properly addressed?
  • Foreign markets: Are international sales or exhibitions planned?
  • Launch timing: Is the filing schedule coordinated with the planned public disclosure?

Prior-design searching can begin through KIPRIS.

However, search results alone do not establish registrability or infringement. The overall appearance and legal scope must be assessed.

9. Frequently Asked Questions

Can I File After Posting Product Photographs Online?

Possibly. The disclosure may raise a novelty issue, and the availability of an exception depends on the statutory requirements and circumstances.

Must Registration Be Completed Before Launch?

Not necessarily. Filing and registration are different events. The timing of filing relative to disclosure is particularly important, but filing alone does not immediately create a registered design right.

Do I Need Design Registration If I Already Filed a Patent?

Possibly. Patents and designs protect different subject matter, so both may be useful for the same product.

Can I Register a Design Similar to a Competitor’s Product?

The answer depends on the earlier design, the degree of similarity, the ease of creation, filing dates, and other legal requirements.

10. Conclusion — Include Design Filing in the Product Launch Schedule

Design registration should not be considered only after a product becomes commercially successful.

If a product’s appearance is an important competitive feature, the filing schedule should be coordinated with prototype completion, photography, advertising, exhibitions, and online sales.

Public disclosure before filing can create novelty problems, and the statutory exception has important limitations.

Where practical, businesses should evaluate prior designs and file appropriate design applications before publicly disclosing their products.

Sky Patent & Law Firm provides services relating to design registrability assessments, prior-design searches, design applications, partial and related design strategies, and examination responses.

Businesses preparing for a product launch or evaluating an already disclosed design should review the product’s appearance, disclosure history, and commercial plans together.
