Patent examination does not necessarily move directly from filing to allowance. The examiner searches prior art and evaluates novelty, inventive step, disclosure and other statutory requirements. If an issue is found, the Office may issue a notice of rejection grounds, and the applicant can respond with arguments and amendments.

The main value of ultra-fast examination is therefore that substantive uncertainty can be addressed much earlier. A first result that contains rejection grounds can still be valuable.   • basic company and founder documentation likely to be relevant to eligibility;
  • a one-page architecture of the core product or service;
  • the technical difference and effect compared with existing approaches;
  • inventor list and company ownership records;
  • scheduled public disclosures and materials already disclosed;
  • a focused comparison of key competitor or prior patents;
  • Korean first-filing and foreign-filing dates;
  • a six- to twelve-month schedule for investment, PoC, procurement and exhibitions; and
  • a portfolio map distinguishing core filings from follow-on filings.

Practice point: Think of ultra-fast examination as a way to “meet the examiner earlier.” To make that early meeting valuable, define the invention and claims before focusing on speed.

What should a startup do between now and November?

First, determine whether product disclosure, financing or launch makes it necessary to file before November. Second, define the core invention and likely design-arounds and prepare the specification. Third, when the November implementation guidance is released, verify whether the company and application actually meet the official criteria. Fourth, decide how the early examination result will feed into investment, foreign filing and follow-on R&D decisions.
