Can a descriptive product name be registered as a Korean trademark?
A product name should be understandable, but explaining the product clearly and building a registrable, protectable trademark are different objectives. Ask whether the name tells customers only what the product is or also helps them identify its commercial source.
This article uses Article 33 of Korea’s Trademark Act and the published summary of the “Eomuk Burger” decision to explain preparation before filing and possible responses to a refusal. Separate practical examples are hypothetical and should not be confused with the actual decision.
Run two separate checks: possible conflicts with earlier marks, and the proposed name’s own distinctiveness. Few search results do not resolve a distinctiveness issue.
1. Why can a descriptive name be difficult to register?
Article 33(1)(3) addresses signs consisting only of ordinary descriptions of characteristics such as ingredients, quality, effects or purpose. Paragraph (1)(7) addresses other signs that cannot distinguish commercial source.
