한국 상표법상 상표권자·전용사용권자·통상사용권자 누구도 정당한 이유 없이 등록상표를 지정상품에 대해 취소심판 청구 전 계속 3년 이상 국내에서 사용하지 않았다면 불사용취소심판의 대상이 될 수 있습니다. 단순 갱신과 실제 사용증빙 관리는 별개의 문제입니다.

갱신만으로는 부족합니다. 상표 갱신은 존속기간을 관리하는 절차이고, 불사용취소는 등록상표가 실제로 사용되었는지를 다투는 별도의 문제입니다. 따라서 등록증과 갱신 영수증만 보관할 것이 아니라, 시장에서 상표가 사용된 모습과 그 시점을 함께 관리해야 합니다.
이 글은 한국 상표법 제119조를 기준으로, 사업자가 무엇을 확인하고 어떤 자료를 준비해야 하는지 설명합니다. 아래 사례는 이해를 돕기 위한 가상 예시이며 실제 수임사건이나 승소 사례가 아닙니다.
먼저 기억할 점: 3년이 지났다고 등록이 자동으로 없어지는 것은 아닙니다. 그러나 갱신을 완료했다는 사실만으로 불사용취소 청구를 막을 수도 없습니다.
1. 불사용취소는 어떤 경우에 문제 되나요?
상표법 제119조 제1항 제3호는 상표권자·전용사용권자·통상사용권자 누구도 정당한 이유 없이 등록상표를 지정상품에 대해 심판청구 전 계속 3년 이상 국내에서 사용하지 않은 경우를 취소사유로 정합니다. 판단할 때는 다음 질문을 따로 확인해야 합니다.
- 누가: 등록명의자 또는 사용권자가 사용했는가?
- 무엇을: 실제 표시한 상표가 등록상표와 어떻게 대응하는가?
- 어느 상품에: 그 사용이 청구 대상 지정상품과 연결되는가?
- 언제·어디서: 관련 기간 안의 국내 사용임을 확인할 수 있는가?
매출이 적다는 사실만으로 결론을 내리거나, 해외 매출이 있다는 이유로 국내 사용까지 입증된다고 생각하면 판단을 놓칠 수 있습니다.

2. 등록일·갱신일·마지막 사용일은 왜 따로 관리해야 하나요?
사업자가 흔히 만드는 상표 목록에는 등록번호와 갱신기한만 들어 있습니다. 여기에 마지막으로 확인되는 사용일, 사용한 상품, 증거파일 위치를 추가하면 관리 목적이 달라집니다. 기한을 놓치지 않는 것뿐 아니라 실제 사용의 공백도 발견할 수 있기 때문입니다.
가상의 의류 브랜드가 오랫동안 판매를 중단했다가 갱신료만 납부했다고 가정해 보겠습니다. 갱신 서류는 권리의 형식적 유지와 관련된 자료지만, 특정 시점에 의류에 그 상표가 붙어 판매·유통되었다는 사실을 대신 보여주지는 않습니다. 반대로 판매가 계속되고 있어도 외주 판매사의 자료가 삭제되었다면 사용 사실을 정리하는 데 어려움이 생길 수 있습니다.
‘사용하고 있다’와 ‘사용을 입증할 수 있다’는 항목을 함께 점검해야 합니다.
3. 어떤 증거를 모아야 하나요?
한 장의 자료에 모든 정보가 들어 있을 필요는 없습니다. 다만 여러 자료가 같은 상품·같은 거래·같은 시기를 가리키도록 연결되어야 합니다. 다음은 증거 정리를 위한 실무 점검표이며, 특정 자료만 제출하면 반드시 인정된다는 뜻은 아닙니다.

예를 들어 세금계산서에 품목이 ‘상품’이라고만 적혀 있다면 해당 서류만으로는 어떤 상표의 어떤 상품인지 드러나지 않을 수 있습니다. 상품코드·주문번호·출고자료를 대조해 설명할 수 있는지 확인하세요. 현재 화면의 캡처만 보관하기보다 과거 거래와 연결되는 원자료도 남기는 것이 좋습니다.
증거는 양보다 연결성이 중요합니다. 사진은 있는데 날짜가 없거나, 거래일은 있지만 상표가 보이지 않는 경우에는 서로 연결할 자료가 무엇인지부터 찾으세요.
4. 홈페이지에 로고가 있으면 충분한가요?
회사 소개 화면에 로고가 있다는 사실과, 심판 대상 상품에 등록상표를 사용했다는 사실은 항상 같지 않습니다. 사이트에서 어떤 상품이 소개되거나 판매되었는지, 당시 실제 공개된 내용이 무엇인지, 상표가 출처를 나타내는 방식으로 표시되었는지를 살펴야 합니다.
사업자가 웹사이트를 개편할 때에는 이전 제품페이지, 배포한 카탈로그, 플랫폼 상품정보 등을 보관할 담당자를 정해두는 것이 좋습니다. 화면을 보관할 때 URL과 확인일도 기록하되, 캡처한 날짜가 곧 과거 게시일의 증명은 아니라는 점에 유의하세요. 주문·광고 집행 기록처럼 다른 자료와 대조하는 과정이 필요할 수 있습니다.
5. 계열사나 판매업체가 사용한 경우는 어떻게 정리하나요?
법은 사용권자의 사용도 고려합니다. 하지만 ‘같은 그룹 회사니까’ 또는 ‘우리 물건을 파니까’라는 설명만으로 모든 관계가 정리되는 것은 아닙니다. 누가 어떤 권한으로, 어느 기간에, 어떤 상표를 사용했는지 확인해야 합니다.
등록명의자와 실제 사업자가 다른 경우에는 계약·승인 내역과 사용자료를 함께 모으세요. 계약이 존재한다는 사실만으로 실제 사용까지 증명되는 것은 아니므로 제품·광고·거래 자료도 필요합니다. 유통사의 판매인지 독자적인 상표 사용인지 등 거래 구조에 따라 검토할 내용도 달라집니다.
브랜드 리뉴얼로 로고나 문구를 바꿨다면 옛 등록형태와 현재 사용형태도 나란히 놓고 검토하세요. 비슷해 보인다는 이유만으로 법적으로 같은 사용이라고 단정하지 않는 것이 좋습니다.
6. 여러 지정상품 중 일부만 사용했다면요?
상표법 제119조 제2항은 일부 지정상품에 대한 불사용취소 청구를 허용합니다. 제3항의 사용 입증도 심판청구에 관계되는 지정상품을 기준으로 검토합니다. 따라서 ‘등록된 상품 중 하나라도 썼으니 등록 전체는 안전하다’고 단순화해서는 안 됩니다.
실무적으로는 등록원부의 상품 목록과 현재 사업에서 사용하는 상품 목록을 대조하는 표를 만드는 것이 좋습니다. 청구서를 받았다면 상대방이 어느 상품을 대상으로 삼았는지 먼저 표시하세요. 등록범위 바깥의 신상품을 판매했다는 자료만 모으면 정작 필요한 쟁점에 답하지 못할 수 있습니다.
7. 심판청구서를 받으면 무엇부터 해야 하나요?
우선 송달받은 문서와 지정된 답변기한을 확인하세요. 사건마다 문서와 절차가 다를 수 있으므로 임의로 기한을 계산하지 말고, 받은 서류를 기준으로 일정표를 만드세요.
- 대상 확정: 사건번호, 등록번호, 청구 대상 지정상품, 청구일과 송달일을 정리합니다.
- 증거 보존: 상품페이지·거래 시스템·외주업체 자료가 삭제되지 않도록 원자료를 확보합니다.
- 기간 대조: 확보한 자료가 청구일 전 관련 기간에 들어오는지 확인합니다.
- 주장 정리: 상표 형태·상품·사용자·사용 시점을 자료별로 연결합니다.
- 대응 검토: 사용 입증 또는 정당한 불사용 사유에 관한 법적 검토를 거쳐 답변을 준비합니다.
제119조 제3항은 피청구인의 사용 입증과 정당한 이유의 증명을 규정합니다. 단순한 사업상 어려움이나 재출시 계획이 곧바로 정당한 이유가 된다고 전제하지 말고 구체적인 사정과 증거를 검토해야 합니다.
8. 청구서를 받은 뒤 다시 판매하면 해결되나요?
청구 후의 새 사용만으로 과거의 공백이 치유된다고 볼 수 없습니다. 제119조 제4항은 청구 후 취소사유에 해당하는 사실이 없어져도 취소사유에 영향을 미치지 않는다고 정합니다. 대응의 출발점은 청구 전에 있었던 사실과 자료입니다.
뒤늦게 만든 설명서가 실제 과거 자료를 정리하는 것은 가능하지만, 없던 거래를 만들거나 날짜를 소급한 자료를 제출해서는 안 됩니다. 새 판매계획은 앞으로의 사업 관리와 관련된 문제이고, 이미 청구된 사건의 대응은 별도로 검토해야 합니다.
청구서가 도착했다면: 새 자료를 꾸미기보다 기존 기록을 보존하고, 대상 상품과 기간에 맞춰 검토하는 것이 먼저입니다.
9. 사업자가 바로 적용할 관리표는 어떻게 만들까요?
다음 항목을 상표별로 한 줄씩 관리하세요.
- 등록번호·권리자·등록상표 이미지
- 갱신기한과 담당자
- 실제 사용한 상품 및 현재 표시 형태
- 최근 사용 확인일과 국내 거래·광고 자료 위치
- 실제 사용자와 사용권 관계
- 사용 공백 또는 자료 누락, 다음 점검일
가상의 예: 포장 사진은 디자인팀, 거래자료는 회계팀, 온라인 판매기록은 외주업체가 보관한다면 자료를 모으는 데만 시간이 걸릴 수 있습니다. 담당 부서와 파일 위치를 평소 기록해 두고, 상품코드 등 공통 식별정보로 묶어두세요. 이 관리표는 법정 서식이 아니라 자료를 찾기 쉽게 만드는 내부 관리 도구입니다.

Korean trademark non-use: why renewal alone is not enough
Renewal alone does not resolve non-use risk. Renewal manages the duration of a registration; a non-use cancellation proceeding asks a different question about use of the registered mark. Keep evidence of marketplace use as well as registration and renewal records.
This article explains practical preparation under Article 119 of Korea’s Trademark Act. The examples below are hypothetical illustrations, not accounts of client matters or successful outcomes.
Key distinction: A registration does not automatically disappear after three years without use. Equally, completing a renewal does not by itself defeat a non-use cancellation request.
1. When can non-use become an issue?
Article 119(1)(3) addresses a continuous period of at least three years before the cancellation request during which neither the owner nor an exclusive or non-exclusive licensee used the registered mark in Korea for the designated goods, without justifiable grounds. Separate the following questions:
- Who: Was use by the owner or a licensee?
- What mark: How does the sign actually used correspond to the registration?
- Which goods: Does the use concern goods challenged in the proceeding?
- When and where: Can the evidence establish relevant use in Korea within the period?
Low revenue alone does not answer those questions. Nor should overseas sales automatically be treated as proof of domestic use.

2. Why track renewal dates and last-use dates separately?
A portfolio register often lists only registration numbers and renewal deadlines. Add the last verified use date, the goods involved and the location of supporting files. This helps identify gaps in actual use as well as upcoming administrative deadlines.
Consider a hypothetical clothing brand that stopped selling but paid its renewal fee. The renewal documents do not establish that marked clothing was sold or distributed at a particular time. Conversely, continuing sales may be difficult to document if an outsourced seller has deleted its records.
Review both whether use is taking place and whether it can be demonstrated.
3. Which evidence should you organise?
No single document needs to show everything. However, the records should connect to the same goods, transaction and period. This table is a preparation aid, not a guarantee that any listed document will be accepted.

An invoice that says only “goods” may not identify the relevant branded product. Check whether product codes, order numbers and dispatch records supply that connection. Preserve underlying records rather than relying solely on a current screenshot.
Connections matter more than volume. If a photograph has no date, or an invoice does not identify the mark, find the records that connect them.
4. Is a logo on a website enough?
A logo on a corporate profile page does not necessarily establish use for the goods challenged in a proceeding. Review which products were advertised or sold, what was actually public at the relevant time and how the sign identified commercial source.
Before a website redesign, assign someone to preserve earlier product pages, catalogues and platform listings. Record URLs and capture dates, but remember that a screenshot’s capture date does not itself prove an earlier publication date. Orders or advertising records may provide useful context.
5. What if an affiliate or seller used the mark?
The Act recognises licensee use, but a group relationship or sales relationship does not explain every issue. Identify who used the mark, under what authority, during which period and in what form.
Where the registered owner and operating business differ, organise authorisation records alongside evidence of use. A contract alone does not show that use actually occurred. Product, advertising and transaction records still matter. The trading structure may also affect whether the issue concerns distribution of goods or a separate authorised use.
If a rebrand changed the wording or logo, compare the registered and current forms. Do not assume that visual similarity necessarily satisfies the legal assessment.
6. What if only some designated goods were used?
Article 119(2) permits a non-use request directed at only some designated goods. The use-evidence provision in paragraph (3) concerns goods involved in the cancellation request. Avoid assuming that use for any item anywhere in the registration makes the entire registration safe.
Map the registered goods against the products actually sold. If a petition arrives, mark the goods the petitioner has challenged. Evidence relating only to new products outside that scope may fail to address the relevant question.
7. What should you do when a petition arrives?
Start with the documents served and the response deadline specified in them. Build the timetable from the actual papers rather than an assumed standard deadline.
- Identify the case, registration, challenged goods, filing date and service date.
- Preserve product pages, business-system records and external supplier files.
- Check whether the evidence falls within the relevant period before the request.
- Link the mark, goods, user and date in an evidence schedule.
- Obtain a legal review of the use evidence or claimed justifiable non-use grounds before preparing the response.
Article 119(3) addresses the respondent’s proof of use and proof of justifiable grounds. Ordinary commercial difficulties or an intention to relaunch should not simply be assumed to satisfy that exception.
8. Can restarting sales after the petition solve the problem?
New use after the request should not be assumed to cure the earlier gap. Article 119(4) addresses the continued effect of the cancellation ground despite subsequent changes. Start with facts and records that existed before the request.
A later explanatory statement can organise genuine historical records. It must not invent transactions or backdate evidence. Future sales planning and the defence of an already-filed proceeding need separate consideration.
If a petition has arrived: Preserve existing records and review the challenged goods and relevant period before trying to create new material.
9. What should an internal monitoring sheet contain?
Use a row for each mark with its registration number, owner, registered image, renewal deadline and responsible person. Add the goods actually used, the current mark presentation, last verified use date, domestic transaction or advertising evidence, user and licence relationship, missing records and next review date.
For example, a design team may hold packaging images, accounting may hold invoices and an outside agency may hold online sales records. Recording the responsible department and file location in advance can save time. Connect records using common identifiers such as product codes. This is an internal organisation tool, not a prescribed legal form.
10. What should you bring to a consultation?
