Madrid international filing or direct national applications: which route fits an overseas brand expansion?
Companies often start with one question: “Is the Madrid System simply cheaper and easier?” The answer depends on the target markets and the condition of the mark. The Madrid System can streamline the filing and later administration of a multi-country trademark portfolio, but protection in each designated member remains subject to that member’s domestic trademark law and examination.
WIPO currently states that the Madrid System has 117 members covering 133 countries. It highlights the ability to seek protection through one international application, in one of three languages—English, French or Spanish—with fees paid in one currency, Swiss francs.

A Madrid registration is not one worldwide trademark right
An international registration does not create a single trademark right enforceable everywhere. It is a centralized route for requesting protection in designated members. Each designated member’s domestic law determines whether and to what extent protection is granted. One country can refuse protection while another accepts the mark.
